1. Who are we and how to contact us
The MoneySuperMarket SuperSaveClub reward scheme described in these terms and provided through our mobile application (“App”) and this website (the “SuperSaveClub”), are operated and provided by MoneySuperMarket.com Limited ("we", "us" or "our"). We are registered in England and Wales under company number 03945937 and have our registered office at Mony Group House, St David's Park, Ewloe, Chester, United Kingdom, CH5 3UZ. Our registered VAT number is GB 741905338.
We are an appointed representative of Mony Group Financial Limited who are registered in England and Wales with company number 03157344. Mony Group Financial Limited is authorised and regulated by the Financial Conduct Authority under FCA registration number 303190. You can check this yourself on the FCA register which can be accessed here.
To contact us, please use our contact form which can be accessed here. Please note that all communications (including formal notices) sent in accordance with these terms must be sent by email. Important: You must ensure that the email address we hold for you is kept up-to-date and that you have full access to it - we will be sending you important messages there. If you change email address, then you must change the address we hold for you on your account.
2. What’s in these terms?
These terms tell you the rules for becoming a SuperSaveClub member and for using the SuperSaveClub via this website and our App. You should contact us if you need help in understanding any part of them.
You must take the time to read and understand these terms before joining the SuperSaveClub. By joining the SuperSaveClub, you confirm that you accept these terms and agree to comply with them. If you do not agree with these terms, you must not join or otherwise access the SuperSaveClub.
We recommend that you print a copy of these terms for future reference.
We may amend these terms and the SuperSaveClub from time to time in accordance with Clause 4 below. Every time you wish to access and/or use the SuperSaveClub, please check these terms to ensure you understand the terms that apply at that time.
3. There are other terms that may apply to you
These terms refer to the following additional terms, which also apply to your use of the SuperSaveClub:
a) Our Privacy Notice, which explains how we collect, use and store your personal data.
b) Our Cookie Policy, which sets out information about the cookies on our site.
c) Free Days Out Terms and Conditions, which sets out the terms and conditions applicable to your Free Days Out pass.
d) Our Cashback Terms and Conditions which set out the terms applicable to our cashback services.
Additional terms and conditions may be in place for different offers including, but are not limited to, Refer a Friend and Super Save Price Promise. Your participation in these parts of the SuperSaveClub will be considered as acceptance of the additional terms and conditions.
If you purchase any third party product or services, additional terms may apply between you and the relevant third party. We recommend that you read and understand any third party terms and conditions relevant to your purchase. If you are unhappy with any product or service you have obtained from a third party or have any complaint regarding any third party, you should address your complaint directly to that third party. We are not a party to any of your transactions with third parties (including retailers) and we are not the seller or supplier of, and do not endorse, any of the goods or services that they make available to you. We do not have any of the legal obligations that apply to the sellers of those goods or services.
We use third parties TLC Worldwide HQ Limited (“TLC”) and Giftcloud Limited (“Giftcloud”) to manage the MoneySuperMarket SuperSaveClub Rewards. Each of TLC’s and Giftcloud’s use of your data will be governed by their applicable privacy policies. Please visit TLC’s website to view TLC’s privacy policy and Giftcloud’s website to view Giftcloud’s privacy policy. Please note that both TLC’s and Giftcloud’s privacy policies are different from our Privacy Notice It is your responsibility to ensure that you understand and agree with the privacy policies of TLC and Giftcloud. We are not responsible or liable for any loss or damage you may suffer or incur in connection with the privacy policy applying to any third party website or for any acts, omissions, errors or defaults of any third party in connection with that privacy policy.
4. We may make changes to the SuperSaveClub Services and these terms
We may update and change the SuperSaveClub (including our website and App) to reflect changes to our users' needs and our business priorities. When we do so, we will post the new version of these terms and conditions on our website and App, and the new version of these terms and conditions will take effect, and will govern the SuperSaveClub and your relationship with us:
commencing no less than thirty (30) days after the date of posting (or such later date as we indicate in the relevant posting), if any of the changes are capable of adversely affecting you. If you do not wish to be governed by the new version of the terms you may notify us on or before the date when the terms are to take effect, and from that date you must cease to use the SuperSaveClub Services; or
immediately upon the date of posting (or such later date as we indicate in the relevant posting), if the changes do not adversely affect you – examples of which would include, without limitation, changes to contact details referred to, or the refinement of provisions that are already included, in these terms.
5. What is the MoneySuperMarket SuperSaveClub?
SuperSaveClub is a rewards club that is exclusive to MoneySuperMarket customers. You must meet the eligibility criteria set out in Clause 6 below in order to become a member of the SuperSaveClub.
Once you have become a SuperSaveClub member, you will be eligible to receive certain SuperSaveClub rewards.
6. Eligibility Criteria
To become a SuperSaveClub member you must:
a) be a UK resident and aged 18 or over only;
b) have a valid email address;
c) have a MoneySuperMarket account; and
d) have made a Qualifying Purchase (please see Clause 7 for information on what constitutes a Qualifying Purchase) or have subscribed to Credit Score (and remained subscribed for 45 days from the date of subscription),
(together, the “Eligibility Criteria”).
It is at our discretion whether to accept or reject you as a SuperSaveClub member and meeting the Eligibility Criteria does not mean you will automatically be accepted, nor are we responsible or liable to you should you not fulfil the Eligibility Criteria.
7. What is a Qualifying Purchase?
A “Qualifying Purchase” means a purchase of any of the following products made when you are logged into the MoneySuperMarket website or App during the applicable Qualifying Period

You must apply for the Qualifying Product using same email address as is used for your MoneySuperMarket account.
When you make a Qualifying Purchase, you will be credited with a reward of up to £20 if you subsequently join our SuperSaveClub within 60 days of the date of the Qualifying Purchase. You will have no entitlement to this reward unless you do so within this deadline. The details of rewards can be found in Clause 10 (b).
Please note that a subscription to Credit Score will not be considered to be a Qualifying Purchase, but as long as you are (a) actually provided with a Credit Score; and(b) remain subscribed to Credit Score for 45 days from the date you signed up to the subscription then you will be eligible to become a member of the SuperSaveClub.
Once you have joined the SuperSaveClub you will then need to redeem your reward for a gift card within 12 months of the Qualifying Purchase (please note that this is not the date you joined the SuperSaveClub, but the date when you made your initial purchase). Failure to do so within this period will mean you will not be able to claim your reward, but will not affect your membership of the SuperSaveClub.
Please note that we will process your rewards as soon as possible, but it may take as much as 90 days from the date of your Qualifying Purchase or Further Purchase (as the case may be) for your SuperSaveClub account to be credited with your reward.
8. Creating a MoneySuperMarket account
To be eligible for SuperSaveClub membership, you must have a MoneySuperMarket account. If you do not have a MoneySuperMarket account, you can create one via our website or the App, as described below.
Creating an account via the MoneySuperMarket website:
Go to our website at www.moneysupermarket.com and select "Sign in".
Enter your email address in the box below the instructions to "Sign in or Create an Account" and provide the required details to sign up.
You’ll then need to follow the instructions contained in the email response before your MoneySuperMarket account is activated.
Creating an account via App:
Download the App from your iOS or Android mobile device or tablet Application Store and tap on the “Create Account” button.
Enter your email address and follow the instructions in the email response.
9. How to join the SuperSaveClub
[You will be eligible for the MoneySuperMarket SuperSaveClub if you meet the Eligibility Criteria. Your MoneySuperMarket account will be updated to include a new SuperSaveClub section. You can join the SuperSaveClub by clicking “Join Now” in that section and then making an eligible purchase.
10. SuperSaveClub Rewards and benefits
As a member of the SuperSaveClub you’ll be eligible to receive a number of benefits and rewards. The details about what these rewards include, and how to access and redeem them, are set out in this Clause 10.
a) MoneySuperMarket Free Days Out annual pass
All SuperSaveClub members receive a MoneySuperMarket Free Days Out annual pass. You can access your pass via our App.
The MoneySuperMarket Free Days Out annual pass lets you visit the UK’s top attractions for free over 12 consecutive months. Your pass will start from the date you make a Qualifying Purchase Please note that there are certain restrictions on how often you can receive a Free Days Out pass for a specific venue – more information on this can be found in our App.
To access the MoneySuperMarket Free Days Out annual pass, you’ll need to use the MoneySuperMarket App - see Clause 8 on how to download the App.
When you open the App, tap on the MoneySuperMarket SuperSaveClub icon. On the MoneySuperMarket SuperSaveClub tab, you’ll then need to go to the Free Days Out section to open the MoneySuperMarket Free Days Out website.
The MoneySuperMarket Free Days Out annual pass is managed by TLC Worldwide HQ Limited (“TLC”) and is subject to the MoneySuperMarket Free Days Out Terms and Conditions, which are incorporated into these terms.
b) Gift cards for “Qualifying Purchases” or “Further Purchases” (together the “Purchases”)
As a SuperSaveClub member, you will be eligible to receive a gift card of between £2.50 and £20 for your Qualifying Purchase and every time you make a Further Purchase on the MoneySuperMarket website or App (“Save More, Get More”).
The following products are classed as Purchases for the purposes of the Save More, Get More reward scheme, and the corresponding gift card amounts are set out below:

We may at our discretion offer rewards greater than the amounts set out above. Any such offer will only be available for limited periods of time, will be specified in promotional materials and may be withdrawn by us at any time.

You may receive a gift card where a friend you have referred purchases certain products through our ‘Refer a Friend’ scheme as follows:

To Refer a Friend, you can access a link from our website or through the App. If you share this link with an Eligible Friend (as defined below), you may receive a reward if your Eligible Friend:
(i) has used the unique referral link received from you to access the MoneySuperMarket.com website or App;
(ii) has either logged into or created an account on the MoneySuperMarket.com website or the App; and
(iii) subsequently has purchased one of the products in the table in 10 (c) above.
An “Eligible Friend” is someone who:
(i) is a new customer to MoneySuperMarket.com, or has not purchased one of the products in the table in 10 (c) above through the MoneySuperMarket website or App since 1 January 2020;
(ii) is a UK resident and aged 18 or over;
(iii) has a valid email address;
(iv) has a MoneySuperMarket account, or creates a MoneySuperMarket account through your Refer a Friend link.
You can share unique referral links with an unlimited number of Eligible Friends. The referral links will not work if sent to anyone who does not meet the Eligible Friend criteria set out above.
Within 90 days of an Eligible Friend purchasing one of the products in the table in 10 (c) above using the unique referral link you provided them, we will notify you whether you and your Eligible Friend have satisfied the requirements of the Refer a Friend scheme in order to be eligible to receive a reward. We reserve the right to ask for additional information to verify eligibility.

A maximum of one gift card with a value of up to £20 is available for the referrer.
(d) Refunds and gift cards of up to £20 where you use our Super Save Price Promise(certain products only)

SuperSaveClub members may have access to other offers and discounts from time to time. Where product providers offer their own additional vouchers or discounts for purchasing their products through the MoneySuperMarket website or App, these will be distinct from the SuperSaveClub Rewards and the terms and conditions of the product provider will apply.
Access to our cashback service may be made available to you through our cashback service Quidco. This service is operated by Quidco Limited, a MONY Group company, and is subject to the Cashback Terms and Conditions. We may also make discount codes and offers available to you via other chosen partners from time to time. Where MoneySuperMarket SuperSaveClub gives access to partner discounts and/or offers, the partner terms and conditions will apply. We accept no responsibility for how they administer their discounts and offers and these may be withdrawn or altered without prior notice.
These discount codes and offers can be found in the MoneySuperMarket SuperSaveClub Club section of your account and is updated regularly.
11. The SuperSaveClub Rewards Hub
You will be able to view any SuperSaveClub Rewards you’ve earnt through Price Promise, Refer a Friend and Purchases in the “MoneySuperMarket SuperSaveClub” section of your MoneySuperMarket account or in the App.
Your MoneySuperMarket SuperSaveClub Wallet (accessible via either the App or through the Website) will let you know the total monetary value of the SuperSaveClub Rewards you’ve earned. It will also let you know the amount that is redeemable at that time and any amounts that are pending.
If a SuperSaveClub Reward is labelled in your SuperSaveClub Wallet as pending, it means that either your Purchase, or Refer a Friend transaction has not yet been finalised and the applicable transaction has not yet been completed (or you are still in a cooling off period). Once the transaction is completed, your SuperSaveClub Reward will be redeemable and may be redeemed in whole. You will not be able to use any SuperSaveClub Rewards that are pending.
Once you redeem a SuperSaveClub Reward, it will be listed as redeemed in your SuperSaveClub Wallet.
12. How to redeem your SuperSaveClub Rewards
The SuperSaveClub Rewards gift card claim procedure is managed by Giftcloud on our behalf. See Clause 10 (a) for accessing MoneySuperMarket Free Days Out annual pass.
To redeem your SuperSaveClub Rewards, you will need to go into the MoneySuperMarket SuperSaveClub tab in your account via our App and click into your SuperSaveClub Wallet. Where you have earnt rewards through MoneySuperMarket Super Save Price Promise, your rewards will be added to your SuperSaveClub Wallet.
SuperSaveClub Rewards are valid for 12 months from the date they are made “redeemable” in your SuperSaveClub Wallet. The expiry date for each of your SuperSaveClub Rewards will be listed in your SuperSaveClub Wallet, beyond which they cannot be used or reissued.
The maximum number of SuperSaveClub Rewards (other than rewards received in connection with the Super Save Price Promise or Refer a Friend schemes) which can be earned for each participating product is 5 in any 12 month period.
Gift cards
To enable you to claim a gift card, we will need to share your data with Giftcloud. Your data will only be shared with Giftcloud if you have met the MoneySuperMarket SuperSaveClub Eligibility Criteria and have had SuperSaveClub Rewards confirmed.
If you are eligible to claim SuperSaveClub Rewards, within 72 hours of pressing the “Redeem” button confirming you’d like to go ahead and redeem your reward, you’ll receive an email from Giftcloud. This email will enable you to claim your SuperSaveClub Rewards gift card. By clicking on the email link you’ll be able to select which brand of gift card you’d like and provide an email address or mobile number for where you’d like the gift card to be sent. Once you’ve done this, the gift card will be sent to the email address or mobile number that you’ve chosen.
You will have up to 90 days from Giftcloud’s email to claim your SuperSaveClub Rewards gift card. You will forfeit your SuperSaveClub Rewards gift cards if you do not claim your SuperSaveClub Rewards gift cards within that time. Please ensure that the email address no-reply@giftcloud.com is added to your safe-senders list, in order to prevent any likelihood of the emails landing in the spam folder.
If the SuperSaveClub Rewards gift cards are not received 72 hours after you’ve redeemed them then you should contact rewards@moneysupermarket.com, who are open Monday to Friday 9.00am to 5.30pm.
All SuperSaveClub Reward gift cards are subject to the reward issuer’s own terms and conditions (which are different from ours). It is very important that you read and understand these terms and conditions before you claim your SuperSaveClub Rewards gift cards. The terms will be made available to you at the point when you can claim your SuperSaveClub Rewards gift cards.
13. Microrewards
From time to time, we may offer rewards for completing specific tasks—like trying a new feature, making a purchase, or joining a challenge.
We’ll always let you know what the task is, what the reward is, and what you need to do to earn it. Each offer will have its own rules, and you’ll need to follow them to qualify.
Rewards may be subject to expiry dates, limits, or other conditions, which we’ll set out clearly when the offer is made. We may change or withdraw offers at any time.
Rewards can’t be exchanged for cash unless we say so, and they’re just for you—so you can’t transfer them to anyone else
14. Important Information relating to SuperSaveClub and SuperSaveClub Rewards
SuperSaveClub members are entitled to access SuperSaveClub Rewards through only one MoneySuperMarket account each. We reserve the right to refuse, merge or close additional accounts at any time.
As a SuperSaveClub member, we'll email you when you have SuperSaveClub Rewards. If you’ve given us permission, we’ll also let you know about ways to maximise super savings and SuperSaveClub Rewards.
It is your responsibility to register your personal details and let us know of any changes. MoneySuperMarket is not responsible for any loss of SuperSaveClub Rewards incurred as a result of out-of-date details. Members with out-of-date details may be removed from MoneySuperMarket SuperSaveClub and SuperSaveClub Rewards may be forfeited.
YOU MUST BE LOGGED IN TO YOUR MONEYSUPERMARKET ACCOUNT AND EITHER (A) MAKE A QUALIFYING PURCHASE; (B) MAKE A FURTHER PURCHASE; (C) MAKE A REFERRAL THROUGH OUR ‘REFER A FRIEND’ SCHEME; AND/OR (D) USE THE SUPER SAVE PRICE PROMISE, TO BE ELIGIBLE FOR MONEYSUPERMARKET SUPERSAVECLUB REWARDS. SuperSaveClub Rewards will not be awarded for non-qualifying purchases. Other than with regard to Broadband and Mobile applications, switches or purchases that are incomplete, cancelled, or reversed within 14 days of purchase (or in the case of insurance products, within the later of 14 days from when the policy begins or when you receive your policy documents), or made available to you through other channels or through cashback sites (including Quidco) will not be eligible for SuperSaveClub Rewards.
With regard to Broadband and Mobile applications, switches or purchases that are incomplete, cancelled, or reversed within 90 days of purchase will not be eligible for SuperSaveClub Rewards.
The SuperSaveClub Rewards are subject to promotional availability. You must not transfer, resell auction or exchange any of your SuperSaveClub Rewards. SuperSaveClub Rewards cannot be redeemed for cash or otherwise substituted for any other prize, reward or other cash value except that in the event of circumstances outside of our control, we reserve the right to substitute similar rewards of equal value. Members can redeem a maximum of £250 in any one gift card.
With regard to MoneySuperMarket’s Price Promise, a maximum of one gift card with a value of up to £20 is available for each validated Cheaper Quote.
MoneySuperMarket may set a limit on the number of SuperSaveClub Rewards that may be earnt. Any purchase of products, Qualifying Purchases, Further Purchases, participation in the SuperSaveClub beyond what could reasonably be considered consumer behaviour or personal use may be deemed to be an abuse of the MoneySuperMarket SuperSaveClub. In this event we may terminate your account at our sole discretion.
MoneySuperMarket SuperSaveClub and SuperSaveClub Rewards are for personal and consumer use only.
We may decline or withdraw access to the SuperSaveClub where we believe you have abused or attempted to abuse the SuperSaveClub Rewards scheme, you have breached or attempted to breach any provision of these terms and conditions and/or those relating to the different offers available via the SuperSaveClub, you have committed any fraud, theft, misconduct, or abusive or offensive behaviour, or you have supplied false or misleading information.
SuperSaveClub Rewards may be removed or cancelled (even if they have already been marked as redeemable) if we consider that the gift cards were collected in breach of these terms and conditions or were earnt fraudulently, invalidly, using automated means, or in error.
We will be entitled to cancel or remove SuperSaveClub Rewards at any time if purchases are cancelled, reversed or amended for any reason.
15. Our rights in relation to the SuperSaveClub
We are the owner or the licensee of all intellectual property rights in and relating to the SuperSaveClub, including the material published on our website and the App. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You must not copy, distribute, show in public or create any derivative work from any element of the SuperSaveClub, including any material published on our website and App, unless you are properly licensed to do so by us or our licensors. You must not use any part of the content of the SuperSaveClub for commercial purposes without first obtaining a licence from us or our licensors to do so.
16. Do not rely on the information on the website and App
The content on our website and App, and any other information provided to you through the SuperSaveClub, is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.
17. How we may use your personal data
Our Privacy Notice sets out details of how we handle your personal data and related matters.
18. We are not responsible for websites we link to
Where the SuperSaveClub materials on our website and App contain links to other sites and resources provided by third parties, these links are provided for your information only. We are not liable for any transactions you make with third parties including (without limitation) all claims and demands relating to transactions (whether completed or uncompleted) with retailers, or goods or services offered for sale or supply, or actually sold or supplied, through or in connection with any transactions with retailers.
19. Your obligations relating to the SuperSaveClub
Our website and App, along with the SuperSaveClub and any other services provided in relation to the same, are only targeted to, and intended for use by, individuals located in the UK. If you are not located in the UK, you must immediately discontinue access to the SuperSaveClub.
Your account should be used only for purchases made by and for you. You are not permitted to make any purchases through your account on behalf, or for the benefit, of any other person(s). We reserve the right to require proof of purchase to verify that any purchases you make through your account are not on behalf of another person and we may cancel a SuperSaveClub reward, and/or suspend or terminate your account, if we discover that you made a purchase on someone else's behalf.
You must not enter into, or attempt to enter into, any transaction with a retailer or to endeavour to gain a SuperSaveClub Reward:
by providing personal information belonging to someone else, or a payment method which you are not entitled to use;
by deceptively or unfairly exploiting a retailer's offering; or
in breach of any terms and conditions applied by us or the retailer to that transaction.
You must not misuse the SuperSaveClub by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our site or any part of it. You must not attempt to gain unauthorised access to the SuperSaveClub, the server on which SuperSaveClub materials are stored or any server, computer or database connected to the SuperSaveClub or any other equipment or network connected with the SuperSaveClub. You must not interfere with, damage or disrupt any software used in the provision of the SuperSaveClub or any equipment or network or software owned or used by any third party on which the SuperSaveClub relies in any way. You must not attack the SuperSaveClub via a denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to access the SuperSaveClub will cease immediately.
You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the SuperSaveClub or any other services provided via, or in relation to, the same for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):
any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our site or any data, content, information or services accessed via the same;
any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.
The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).
You shall not use, and we do not consent to the use of, the SuperSaveClub or any data published by, or contained in, or accessible via, the SuperSaveClub or any other services provided via, or in relation to, our website and App for the purposes of developing, training, fine-tuning or validating any AI system or model.
This clause will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
It is your responsibility to ensure that any material you post to our website or App:
is not defamatory, offensive, or abusive or of an obscene, indecent or menacing nature;
is not intended or likely to cause needless annoyance, inconvenience or distress to any person;
does not contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data or personal information;
does not contravene any applicable law or regulation (including, but not limited to, laws governing consumer protection, distance selling, unfair competition, anti-discrimination, false advertising, copyright, trademark and privacy);
does not breach the rights of any person or entity (including any rights or expectations of privacy);
where it constitutes feedback on a retailer, is accurate and fair; and
does not advertise any goods or services.
We are not liable for the review or monitoring of any such material. If you see or experience anything on the SuperSaveClub that appears to infringe any of the above requirements, we would like you to inform us by emailing customerservices@moneysupermarket.com.
We are entitled, but not obliged, to withdraw any material from our website and App, which appears in our reasonable opinion to be in breach of these terms.
We reserve the right to suspend or terminate your access to the SuperSaveClub if, in our reasonable opinion, you have breached of any of these terms including, but not limited to, if you upload any material contrary to these terms. We may also suspend or terminate your access to the SuperSaveClub if you access or use the SuperSaveClub for any non-personal use.
20. Operation of the SuperSaveClub
We do not guarantee that the SuperSaveClub (including our website and App,) or any of the content that appears on it, will be uninterrupted or error-free. We may withdraw, modify or suspend the availability of all or any part of the SuperSaveClub where we have legal, security, technical or commercial reasons to do so.
We will endeavour to give you 30 days advance notice before taking such action, except where it is necessary to take earlier action for security reasons or because of technical difficulties which adversely affect the SuperSaveClub. There may also be times when the SuperSaveClub become inaccessible as a result of technical difficulties. We will use reasonable endeavours to overcome these difficulties where they are within our control.
We will try to ensure that any periods of planned unavailability, which you will be informed of when you access the SuperSaveClub at the relevant time, are kept to a minimum.
For security or other reasons, we may require you to change your password or other information which facilitates access to the SuperSaveClub. Please note that we will never ask you for your password via email, telephone, or any other means other than through the MoneySuperMarket website. You are responsible for maintaining the confidentiality of your username and password.
21. Liability
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence or our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, or our breach of these terms, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge, or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us, or by any events outside of our reasonable control.
We are responsible for losses you suffer which are caused by us failing to comply with these unless the loss is:
Unexpected.
It was not obvious that it would happen and nothing you said to us before you started using the SuperSaveClub meant we should have expected it (so, in the law, the loss was indirect or unforeseeable).
Caused by an event outside our control.
This includes as a result of the nature of electronic transmission of data over the internet.
Avoidable.
Something you could have avoided by taking reasonable action in accordance with these terms.
A business loss.
It relates to your use of our Site or App for the purposes of your trade, business, craft or profession.
22. Other important terms
We can transfer our contract with you, so that a different organisation is responsible for operating the SuperSaveClub, but will not do so in such a way as to reduce any guarantees you are given under these terms. You can only transfer your contract with us to someone else if we agree to it.
These terms are between you and us. Nobody else can enforce it and neither of us will need to ask anybody else sign-off on ending or changing it.
If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
We might not immediately chase you for not doing something or for doing something you're not allowed to, but that doesn't mean we can't do it later.
23. Which country's laws apply to any disputes
These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
