Cashback Terms and Conditions

  1. Who we are and how to contact us 

    Our cashback service is available on our website and the MoneySuperMarket App ("App") is operated by MoneySuperMarket.com Limited ("we", "us" or "our"). We are registered in England and Wales under company number 03945937 and have our registered office at Mony House, St David's Park, Ewloe, Chester, United Kingdom, CH5 3UZ. Our registered VAT number is GB 741905338. 
     
    We are an appointed representative of MONY Group Financial Limited who are registered in England and Wales with company number 03157344. MONY Group Financial Limited is authorised and regulated by the Financial Conduct Authority under FCA registration number 303190. You can check this yourself on the FCA register which can be accessed here. We are accredited under the Ofgem Confidence Code in relation to its energy channel.

Important: You must ensure that the email address we hold for you is kept up-to-date and that you have full access to it - we will be sending you important messages there. If you change email address, then you must change the address we hold for you on your account.

  2. What's in these terms? 

    These terms tell you the rules for obtaining cashback through either this website or the App and the services offered by us through them (the "Cashback Service(s)").  

    You must take the time to read and understand these terms before registering for the Cashback Service. By using the Cashback Service, you confirm that you accept these terms and agree to comply with them. If you do not agree to these terms, you must not use the Cashback Service.  

    We recommend that you print a copy of these terms for future reference. 

    We amend these terms from time to time in accordance with Clause 4 (We may make changes to the Cashback Service and these terms). Every time you wish to use the Cashback Service, please check these terms to ensure you understand the terms that apply at that time.  

  3. There are other terms that may apply to you

    These terms of service refer to the following additional terms, which also apply to your use of the Cashback Service: 

    • our Privacy Policy, which explains how we collect, use and store your personal data including details of your bank account, Paypal account, credit card or other account into which you wish to receive payments through the Cashback Service; 

    • our Cookie Policy, which sets out information about the cookies on our website and App;  

    • the SuperSaveClub Terms and Conditions, which govern our SuperSaveClub. You must be a member of SuperSaveClub to use to the Cashback Service; and 

    • the Terms and Conditions which govern the use of both MoneySuperMarket.com and the MoneySuperMarket App. 

    If you purchase any third party product or service via the Cashback Service, additional terms may apply between you and the relevant third party.   We recommend that you read and understand any third party terms and conditions relevant to your purchase. If you are unhappy with any product or service you have obtained from a third party or have any complaint regarding any third party, you should address your complaint directly to that third party. We are not a party to any of your transactions with retailers and we are not the seller or supplier of, and do not endorse, any of the goods or services that they make available. We do not have any of the legal obligations that apply to the sellers of those goods or services.

  4. We may make changes to the Cashback Service and these terms 

    We may update and change our Cashback Service (including our website and App) to reflect changes to our users' needs and our business priorities. When we do so, we will post the new version of these terms and conditions on our website and in our App, and the new version of these terms and conditions will take effect upon the date of posting (or such later date as we indicate in the relevant posting), if the changes do not adversely affect you - examples of which would include, without limitation, changes to contact details referred to, or the refinement of provisions that are already included, in these terms. 

  5. The Cashback Services 

    The Cashback Services allow you to make purchases from retailers which may qualify for cashback. Unless otherwise indicated, these terms apply to each of element of the Cashback Services. In particular please note that:: 

    • we receive a referral fee ("Referral Fee") for qualifying purchases that you make from a retailer (“Qualifying Transaction”). The Referral Fee is payable to us by the retailer once the retailer confirms that a Qualifying Transaction has been made; 

    • on receipt of the Referral Fee that we receive, we will make cashback payments to you in accordance with these terms.  Please note that MoneySuperMarket is eligible for fees from retailers in connection with each Qualifying Transaction (the “MSM Fees”) and that such MSM Fees do not form part of your Balance.  You are not eligible to receive the MSM Fees; 

    • if you make a Qualifying Transaction for which Referral Fees have been received by us, you will be able to see a positive account balance (a "Balance") in your SuperSaveClub wallet (your “Wallet”) at the date and time the Qualifying Transaction is completed. A Balance does not itself represent a sum of money held by us on your behalf; and 

    • Cashback will only be payable to you once all checks relating to such payment have successfully been completed in accordance with our internal policies. See Clause 7 (Cashback) for more about cashback. 

    When we refer to retailers or retail partners, we mean sellers and suppliers of goods or services that agree to enter into Qualifying Transactions and pay us Referral Fees. Please note that: 

    • we are only eligible to receive a Referral Fee and you in turn are only eligible to receive a Balance to the extent a retailer has tracked a purchase you have made.  If a retailer has not tracked a purchase this will not count as a Qualifying Transaction; and 

    • remittance of any Balance is dependent on the speed which retailers remit payment to us.  We do not prepay Balances or make goodwill payments in the event of delayed payment from retailers.  In no circumstances will we make payment until we have received funds from the retailer in question.  This may take several months in certain circumstances. 

    Please see Appendix 1 with regard to our expected timescales for crediting you with a Balance and when you should contact us if you have failed to receive a Balance. 
    Our help pages and other service documentation available on our website provide further information about the Cashback Services, please do use these should you have any queries or issues about the Cashback Services.  

  6. Obtaining an Account 

    You are only eligible to participate in the Cashback Services if you are a SuperSaveClub member and if you fulfil the eligibility requirements set out in the SuperSaveClub Terms and Conditions (including but not limited to the age requirements set out therein).  You can only have one account and you must be a resident of the UK to register to use the Cashback Services. 

    In using or registering for the Cashback Services, you must provide accurate and current information about yourself, including, where requested, your correct name, address, and any other requested details. 

  7. Cashback 

    After you have successfully completed a Qualifying Transaction for which we have received the Referral Fee we will credit any Balance due to you to your Wallet once all necessary checks relating to the payment have successfully been completed in accordance with our internal policies. 

    Please note that there are various circumstances in which a transaction with a retailer may not constitute a Qualifying Transaction and cashback may not result from it.  There are various circumstances in which sums will not appear in your Wallet, and will be forfeited to us, namely: 

    1. where a Referral Fee is received by us but is not attributed to a Qualifying Transaction or associated with your account (such as where you were not logged-in to the Cashback Service when making the relevant purchase); 

    2. the transaction in question is cancelled after it has been entered into, for example where a purchased product is returned or a right to cancel the transaction is exercised; 

    3. a Balance is attributed to you or your account, where your account has been: 

      1. associated with any fraudulent activity or any breach of these terms; and 

      2. used to make purchases on behalf of, or for the benefit of, any other person. 

    Further circumstances where you are not eligible for Cashback or the full amount of Cashback or where Cashback may be delayed can be found in Appendix 1. 

    Please note that you will only be able to withdraw any Balance credited to your Wallet when your aggregate Balance is equal to £5 or more.

  8. Privacy policy 

    Our Privacy Policy sets out details of how we handle your personal data and related matters. 

    Please note that we will contact you to let you know when your cashback has been tracked and validated. 

  9. We are not responsible for websites we link to 

    Where the Cashback Services contain links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources. 

    We have no control over or responsibility for: 

    1. the quality, safety, or legality of the goods or services available from third party websites; or 

    2. whether the third party can or will supply and pass good title to any goods or services. 

     
    We are not liable or responsible for any transactions with third parties (including retailers), including (without limitation) all claims and demands relating to transactions (whether completed or uncompleted) with retailers, or goods or services offered for sale or supply, or actually sold or supplied, through or in connection with any transactions with retailers. 

  10. Do not rely on information on the website and App 

    The content on our website and App is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our website and App. 

    Although we make reasonable efforts to update the information, we make no representations, warranties or guarantees, whether express or implied, that the content on our website and App is accurate, complete or up to date. 
    We do not guarantee that our website and/or App will be secure or free from bugs or viruses. 
    You are responsible for configuring your information technology, computer programs and platform to access our website and/or App. You should use your own virus protection software. 

  11. Your obligations relating to use of the Cashback Services 

    Our website and App along with its content and any services provided in relation to the same are only targeted to, and intended for use by, individuals located in the UK. If you are not located in the UK, you must immediately discontinue use of the Cashback Services. 

    You must not misuse the Cashback Services by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with the Cashback Services or any part of it. You must not attempt to gain unauthorised access to the Cashback Services, the server on which the Cashback Services are stored or any server, computer or database connected to the Cashback Services or any other equipment or network connected with the Cashback Services. You must not interfere with, damage or disrupt any software used in the provision of the Cashback Services or any equipment or network or software owned or used by any third party on which the Cashback Services relies in any way. You must not attack our website and/or App via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Cashback Services will cease immediately. 

    You must not enter into, or attempt to enter into, any transaction with a retailer or to endeavour to gain cashback: 

    • by providing personal information of someone else, or a payment method which you are not entitled to use; 

    • deceptively or unfairly exploiting a retailer's offering; or  

    • in breach of any terms and conditions applied by us or the retailer to that transaction. 

    In order to prevent misuse of Cashback we may request proof from you that you have made a Qualifying Transaction and in the event you fail to provide such proof we reserve our rights not to pay you any Balance.  We may suspend or terminate your account with us if, in our reasonable opinion, you have breached any of these terms including (but not limited to) if you upload any material contrary to these terms.   

  12. Contact from third parties 
    If any of our retailers or legal or regulatory authorities contacts us in relation to material or transactions associated with you or your Account, then you agree: 

    1. to provide all reasonable information and assistance we may require in connection with responding to that contact; and 

    2. to respond promptly and accurately to it, should we pass the message to you for a response. 

  13. SuperSaveClub key terms and conditions 

    You must be a member of SuperSaveClub to use the Cashback Services and you will be required to comply with the full SuperSaveClub terms and conditions which are available here.  

  14. Additional services 

    We or our partners may offer new or additional services through the Cashback Services from time to time. Your use of those services may be subject to additional terms and conditions.  We are not responsible for any failure by either you or our partners to comply with a provision of the terms governing those services. 

  15. Our App 

    When you use the App you acknowledge and agree to the following: 

    • we will use the personal information we collect in accordance with our Privacy Policy and this will include the personal details you give us when you use the App to send you emails, in-App messaging, and/or push notifications at your request to help you use the App service (e.g. to reset your password or update your details); and 

    • to alert you to changes to our services (e.g. changes to these terms and conditions). 

    To turn off communications from the App, you can go to your App settings or follow the links included at the bottom of the emails (simply deleting the App will not stop these emails). 

  16. Operation of the Cashback Service 

    We do not guarantee that our website or App, or any content on them, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of our website or App for business and operational reasons.  

    We will try to give you reasonable notice of any suspension or withdrawal. There may also be times when the Cashback Service becomes inaccessible as a result of technical difficulties; we will, however, use reasonable skill and care to overcome these difficulties where they are within our control. Please note, however, that we cannot guarantee continuous access to the Cashback Service or any of the content that appears on it. 

    Nevertheless, we will strive to ensure that any periods of planned unavailability, which you will be informed of when you access the Cashback Service at the relevant time, are kept to a minimum. 

    For security or other reasons, we may require you to change password or other information which facilitates access to the Cashback Service; however, we will never ask you for your password via email, telephone, or any other means other than through our website or App. You are responsible for maintaining the confidentiality of your username and password. 

  17. Complaints 

    We aim to provide you with an excellent service at all times. If you are unhappy with our service for any reason, please contact our customer services team here. 

    We will aim to send you a formal acknowledgement of your complaint within 48 hours and to resolve it as soon as possible. After we have had an opportunity to investigate your concerns, we will issue you a final response.  

  18. Liability 

    We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. 

    We warrant that the Cashback Services will be provided with reasonable care and skill with the intention of meeting our specifications for the Cashback Services, but we cannot and do not guarantee that the Cashback Services will meet your requirements. If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us. 

    We only provide the Cashback Services for domestic and private use. You agree not to use the Cashback Services, including our website and App for commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.  

    We are responsible for losses you suffer caused by us breaking these terms unless the loss is: 

    • unexpected – it was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable); 

    • caused by a delaying event outside our control; or 

    • avoidable – something you could have avoided by taking reasonable action. For example, damage to your own digital content or device, which was caused by digital content we supplied and which you could have avoided by following our advice to apply a free update or by correctly following the installation instructions or having the minimum system requirements advised by us. 

     
    In particular we are not liable to you for any failure by any payment services system to remit funds to you or if you provide us with incorrect account details. 

    To avoid doubt, nothing in this Clause 18 (Liability) limits our obligation to pay cashback to you in accordance with the terms of this Agreement. 

  19. Other Important Terms  

    We can transfer our contract with you, so that a different organisation is responsible for providing the Cashback Services.  

    You can only transfer our contract with us to someone else if we agree to do this.  

    These terms and between you and use. Nobody else can enforce it and neither of us will need to ask anybody else sign-off on ending or changing it. 

    If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply. 

    We might not immediately chase you for not doing something or for doing something you're not allowed to, but that doesn't mean we can't do it later.  

    In the event our SuperSaveClub expires or you leave the SuperSaveClub then you will be entitled to any cashback which you have redeemed and this will be paid to you directly.  However, if you have not redeemed any cashback then any such outstanding sums will not be remitted to you  

  20. Which country's laws apply to any disputes?  

    These terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in. 

Appendix 1 – our additional key terms 

  • Cashback is not paid on VAT, delivery charges and any other additional fees. When a minimum spend threshold is required to be eligible for cashback, retailers do not count VAT and fees in the total spend amount. 

  • Cashback is available on genuine, tracked purchases completed immediately and wholly online. 

  • Cashback is not paid on any made to measure items. 

  • Cashback is not paid on the purchase of gift vouchers or gift cards, any reselling activity or any bulk orders deemed as reselling activity rather than genuine personal customers. 

  • Cashback is not paid on purchases made using gift vouchers, gift cards, finance/credit payment options, or rewards points.  

  • Purchases should appear as pending within 24 hours. They will remain at this status until the merchant confirms the purchase is eligible for cashback. Once this happens your purchase will reach the ‘confirmed’ status on your account. 

  • Most transactions from merchants track successfully, occasionally a transaction may not be reported. If you believe this to be the case, please report your transaction as missing within 45 days of making it. 

  • Cashback may initially track at a lower or higher rate and update to the correct rate on confirmation. 

  • Cashback is not issued by the merchant. If you have any queries regarding cashback or payments, please contact Customer Support (details for how to contact them can be found here) directly and not the merchant. 

  • The cashback offered is only available as shown at the time in the SuperSaveClub hub and are subject to change. The merchant also reserves the right to withdraw their offering at any time 

  • If you apply an additional discount that reduces your overall purchase price, this may cause your cashback to be declined or reduced. e.g. Voucher codes, student discount, staff discount.
