There are inevitably different ways to calculate these things if it is not stated specifically in your contract. You should first discuss the matter with your employer and then with your union (if you are a member) before considering taking things further. As long as the method used is reasonable and does not contradict anything written in a contract, there is not a lot that you can do.

Working out Holiday Entitlement when leaving a job

Hello, I've recently left my job and think my employer has got my holidays wrong, let me explain....

In my contract it says I get 23 days in addition to bank holidays.

What my employer has done is add 23 to 8 and given me pro rata of 31 days.

I worked for a month and a half, April and 2 weeks of May, and he has given me 3 days. As we had 3 bank holidays in Apr & May, the 3 days holiday I had in April when my daughter was ill, have been minused off my final salary.

Should I get Pro Rata of 23 days plus whatever bank holidays there were, or pro rata of 31 days?

    Please help?
