    Thanks for your response, we have already filled out a means test for the courts as they were going to take it direct from my husbands wages, we are paying it direct to the company now, and we have to make our 1st payment of £30 by the 14th April, if we don't pay it, it will go back to court and we haven't got anything from them yet to say wether the aggreement was legal or not.

    We did get the court papers but because my husband had signed up with the other company he wouldn't fill in the papers, so they got a ccj against him.

    We are going to send them a the letters requesting all the information they have on him, and the other letter to get a copy of his aggreement because i don't think they have it.

    Don't pay any more money

    Get a portfolio of all the transactions you have made with Welcome Finance - times of telephone calls, what they said and keep all letters.

    Write to Welcome Finance (Recorded Delivery) and state you are not willing to pay another payment and request the agreement and any other correspondance. If they threaten you with Court action 'Let them' this gives you a chance to speak to the judge and explain the situation to them include the history of your husband being made redundant.

    If you don't get the answers even if you don't like them you need to stand your ground. You stated you have a CCJ against you, where you informed of the court action before the judge granted a CCJ - did you like so many people bury your head in the sand and ignore it? becaus if you where not informed then you have grounds to maybe have the CCJ lifted - You have to remember the CCJ is on your credit report for 7 years (I think) after you have paid the debt so this will effect your credit history a lot longer!! - check your report with 'Experian'.

    DO NOT USE DEBT RECONCILIATION COMPANY - GO TO THE 'CAB' WITH ALL YOUR DOCS. As the company you spoke of have done no work on your behalf you are entitled for the money back (£100) as long as no agreement was signed.

    LAST THING - Judges will be more simpathetic to you 'The Consumer' than the supplier. A little tip: If you are having difficulties paying a debt - sit down and write out a 'means test' i.e. what you have coming in and what you have coming out.

    1. List all debts - check each debts interest and then clear the highest first.

    2. Pay your essential bills such as Gas/Elec first (You need to live).

    2. You can have the interest stopped whilst you are in dificulties - speak to the courts they will advise as there is a form you fill in (Don't remember the name but check it out, it might cost you a fee)

    3. Only pay what you can reasonable afford.

    4. Write to your creditors and explain what has happened and state in your recorded delivery letter that you can only pay £10 per month for the next 8 months. If they threaten to take you to court 'Let them'. You have offered to make a payment therefore the Judge will be on your side.

    It is very difficult to advise as I don't know all the issues relating to you. BUT please don't pay out anymore money to any get quick fix promises to clear your debts companies and NEVER sign anything until you have had a cup of tea and slept overnight on it and ofcourse read the small print. GOOD LUCK

    Welcome Finance advice please

    My husband got finance for a car through welcome finance in 2006, 1 month after getting the car he lost his job, so we asked welcome to take the car back as we couldn't afford the payments, they took over a year to take the car back, threatening us with court action in the meantime. After they had taken the car back we didn't here from them for another year, then last year my husband started getting phone calls from them and letters demanding the money, which they had only reduced by £2500, when the car was £5000 when he bought it.

    He now has a ccj against him and has to pay £30 a money with a balance of £7095.62. Before the judgement we had asked for a copy of the aggreement and a statement as we had lost the original, we received a statment but no aggreement.

    Is it too late to ask for the aggreement again and if they haven't got it could he get the ccj removed or stop making payments?

    Also a couple of months ago he instructed a company called unfair credit direct who guaranteed that the they would find that the aggreement was unfair, he paid them £100 and was due to pay them another 4 instalments of £100, but due to financial reasons he hasn't been able to pay the other 4 instalments, they still haven't done anything even though they have had £100 off him, can he claim the £100 back off them or not.
