    I don't know the legal side here but I would trust that CaB do and their advice will be impartial or at least leaning towards your benefit.

    I would follow thwe CaB advice as Welcome are a notorious company and will only be looking out for their own interest and i believe that they have not always followed the legitimate procedure for things like this so they may try anything and say anything if it will get you to turn the car over to thejm so they can resell it again.

    If you are in consultation with a 3rd party regarding legal advice then Welcome will be hard pushed to get this to go through as they will have to offer you every opportunity to gain and act on the legal advice you are seeking. Take your time, wait for the CaB appointment and if CaB says you don't have to hand the car over then I would suggest that you keep it.....if only for the scrap value.

    Remember that Welcome are a business for profit, the CaB are a charity for your benefit and rights!

    Phone National Debtline and/or speak to the insolvency practitioner who dealt with the bankruptcy.

    Welcome finance

    Can anyone help??

    I took out a car loan from the dreaded Welcome Finance. unfortunatly the year after I made myself bankrupt. The car was included in the bankruptcy. Welcome phoned me and I advised them of this, I advised I could no longer afford £230 a month payments. She told me I didnt have to include the car in the bankruptcy(but already had) and that i could reduce the payments. Stupidly I did this. I now find myself unemployed and again cant afford to pay for the car. The car isnt road worthy at the moment, as it needs a new engine, the tax and MOT run out at the end of the month also.

    I was told by welcome that i would need to put it in writing that I want to end the contract, when I had done this I was then told that because I had been bankrupt I would have to write another letter stating that I would like to voulentary surrender the car. I have sought advice from CAB regarding this and they advised me that I didnt have to voulentary surrender the car but write then a letter quoting section 99 of the Consumer Credit Act 1974. I have done this but they are sticking to their decision that I have to voulentary surrender.

    What do I do?? I just want the car gone but because I have read so much bad press from welcome it cant be as simple as writing a letter stating voulentary surrender!! I have also heard they like to bully, but im not scared of them, I giv them what for and dont let them get a word in!!lol

    I hope I can get some advice off here as I cant get an appointment for CAB for another 2 weeks
