Thanks to all who have written replying, I am now finally free of these maniacs.

 I can now tell you all how I did it with the legal stuff out of the way, most importantly you must record all phone conversations with Tiscali, time & date them as with all letters, go through their complaints proceedure, yes I know these don't work, but you have to be seen to have gone through the correct channels, ask for a floor manager and tell them they are being recorded.

[How to record them].... a bog standard microphone stuck to the earpiece of your phone, recording software, I use LP Recorder, works great !!.... Record every call you make.

 You will come to an impass when telling them that they issue the MAC CODE's and not BT, don't worry I got the same lies, you can confirm this with BT if you want.

Tell them you want this taking to a high level complaint, making sure you have told them everything they have said and done has been documented and recorded by audio, that you are or have written to OFCOM, CISAS and that you are taking out legal claims against them, they will respond !!

They in turn will reply back to you via their High Level Complaints officer, then they will take you seriously.
Tell them that all contact between you and Tiscali will be conducted by written letter, that this will keep all correspondance legal and documented, this then starts to shake their foundations... they don't like being caught out when they think there is evidence against them, and when they don't know the content of that evidence. 

 The case can be won by gathering evidence as you go along and proving it by having the evidence if it needs to be presented in a court of law, but here is the most important thing of all.... NEVER give Tiscali the evidence, the dates of reference is all you need to supply them with, the evidence must be kept by you, and make duplicates if your computer goes down.

This method worked for me very well in the end, but note that this took 4 months from following their complaints proceedure.... it's a long hike, but it's got to be that way to keep you legally on track and to gather the evidence of their outrageous conduct.

I hope that this can be useful for anyone else abused by them.

Thanks for your reply, in addition to what you read in my post, Tiscali have been phoning me twice a week for the last two weeks. This is now full on harassment from them, or in particular one person who is an FAO, whatever that is ?

I have now written to CISAS informing them of my position, OFCOM didn't seem to be interested at all, maybe I'll have another crack at them just as you said. The whole thing has dragged on for 4 months now with no ending in sight.

They did put registration and address info in very very small print at the foot of the last letter sent to me. honestly I have no idea what it is going to take to get them totally gone without incurring legal costs ?

Short of seeking them out and physically going to war withem, I am open to any ideas avoiding that !!

Complain to your local trading Standards.

Also complain to Ofcom and insist that they at least take note of your complaint.

Did the letter from Tiscali state their full company name (Tiscali UK Ltd) , company number, registered business address and place of registration? They must put that information in ALL letters and emails, but often don't. Failure to do so is a breach of the Companies Act 2006 punishable by a fine. Again, complain to Trading Standards.

I do appreciate the frustration of being in the right, treated as though one is in the wrong and not being able to ignore a company the way it can ignore its customers. The employees go home at the end of their shift but you're still left there turning things over in your mind. I did look at the Tiscali website in an effort to be of some value to you but have drawn a blank. An acquaintance of mine is good at these sort of problems. If I see him in the near future I will ask him if he has a bright idea.

My problems started the usual way with Tiscali, had bad bad service with them.

1. Got MAC CODE from the 13th Dec 2006
2. Joined BT 20th Dec 2006
3. Got letter from Tiscali Jan 11th 2007 demanding £35.98
4. Account was only owed £17.99
5. Paid £17.99 that was owed.
6. OFCOM got letter from me
7. OFCOM said it didn't enter disputes such as this
8. Every telephone conversation with Tiscali was recorded.
9. Tiscali won't leave me alone, started harrassing me with phone calls
10. Told by Tiscali guy that only BT can give MAC CODES on behalf of any company.
11. Told Tiscali guy that only the current ISP can do this, with BT's blessing.... nuff said !!
12. Argument became a stalemate, told him he was talking BS**

Final position is.... There isn't one !!

How in the name of all that is legal, can Tiscali do this to people ?
I am tearing my already balding hair out over this level of incompetence, I just want Tiscali off my back and out of my life.
Does anyone know how to do this, OFCOM are useless, CAB are just as bad, nobody seems accountable to this truly corrupt company.

Any help would be appreciated and maybe give at least one nights sleep !!
