Just to reiterate when you send your letter to Tiscali make sure you mention the Sale of Goods Act (I'd do a bit more investigation into this first).

Thanks for your email.
At the moment you're bound by a 12 month contract and should you leave you will get charged for the remainder of the contract period. However it doesn't appear that you have ever received the service you've paid for and you are within your rights to cancel your payments to Tiscali since they've reneged on the contract agreement to provide you with the service they said they would provide you with. In contract law this means you have a very strong case and it's unlikely they'll try to take you to court, (although I wouldn't assume they won't).
My advice is to send them a letter and inform them of your problems and that you will cancel all payments, (ie Direct Debits) within 10 working days of the letter being sent. If they want to respond within that time period and try to rectify the siutation you're willing to listen to what they have to say, if they don't I would simply cancel the broadband connection and switch to a new ISP.
Of course the biggest problem with this is that if you leave without their say so they will become a hostile ISP which means it's unlikely they'll give you a MAC code to switch easily so you may have to turn your ADSL connection off before you can reconnect which could take weeks.

Tiscali! the very name brings me out in a cold sweat, why? well in May 2006 after being with Tiscali for a few years, had a letter saying that due to upgrading work on my line I may experience some problems for two hours on the 2nd June 2006. If I had any problems to ring their customer care line ( number supplied. calls charged at local rate ) from 2nd June I never had an internet conection. I rang the number, was kept on hold, taken through setting changes only to be told after 30 mins that they had no idea what the problem was but the suppervisor would ring me back within the hour, after one hour I again rang, kept on hold another half hour, stil no idea what the problem was told that suppervisor would ring me back with 24 hrs, they didnt ring, rang back again and was told that the problem was with the line upgrade which had not been successful.To cut a very long story short,each time I rang I was told I would be re connected in 3 working days, 5 working days, 7 working days, another few working days, then 7 working days, I demanded that they stop lying to me, to no avail,finally decided to change my internet service supplier to someone who would supply an internet service. My new prospective service provider asked to ring Tiscali to get my Mac number, Tiscali wouldnt give it to me, then had the cheek to ask why I was thinking of changing, I told them that I would like an Internet service, she asked would I like to speak to someone about it if I was having a problem. The cost of my many phone call came to quite a lot of money, but the time kept on hold was many many hours. I was without my internet conection all June, July, August and part of September with all the inconvenience that this caused. No recompence was offered, I thought of taking it further but decided my nerves couldnt stand any more and decided to cut my losses.

to jason lloyd and any one else if they can help.................i recently posted a problem about tiscali about not contacting me ....well iv had a reply from them finally.28 DAYS after i sent them an email they have finally returned one 28 DAYS it has took them so obviously i replied again even more angry than i was before .The problems are still happening and in the email they sent me sorry for the delay (i nearly fell of my chair) and they also said if i wanted to disconnect early i would have to wait until may (end of my contract) i cannot get in touch with them,and im getting thrown of the internet , and last of all my connection is so slow iv timed it and its taking 15 to 18 mins just to get on a site .I know its not my computer as iv bought a new tower and upgraded memory and proccessor.please is there any way i can get rid of tiscali now with out paying to the end of my contract or am i stuck paying bills and getting ridiculous service. by the way im still getting bills and offers by email from them but it takes 28 days to email me back when theres a problem any suggestions any1........thanx

It's about to get much worse. Tiscali UKs dire financial position demands a 40% reduction in it's workforce. You can bet your bottom dollar that it will be front line support and "expensive to feed" technical staff that get the boot first. That is of course if they have any staff left with what could be described as technical ability.
One things for sure, the bean counters owe allegiance to the shareholders and the shareholders only - Customers don't fit into the equation.

I joined up to Tiscali broadband - see subforum Tiscali Talk- and when i received my modem installation disc and tried to download it onto my computer, nothing worked, it would not accept the disc, kept sending an error message.
Anyway as i'm not that computer literate i thought i'd give the tiscali broadband support number a go. After numerous calls, they always seemed busy but i'm sure i'll still get charged for them, i eventually got through to someone. This guy went through a checklist etc etc and i did as he was telling me. Eventually he told me to restart my computer then put me on hold for about 5 mins, when he got back to me nothing had changed. He then told me they would send another disc out within 2 days, well i'm still waiting.
I actually got round the problem by phoning my local computer repair shop(freephone) and within 2 to 3 mins they gave me free advice on how to install the disc. Now it works and i'm connected to Tiscali broadband but i await any more problems and having to contact their advice line. As far as i'm concerned they really need to get their act together over this as they seem to have a big advertising spree on the go for Tiscali Talk but i'm afraid it will be the downfall of them if they dont sort this problem out.

hi , im also new to this ,i took out broadband with tiscali in march i had problems with speed and getting chucked of a few websites .I tried to contact tiscali but they sent me a message just like (swanseagaz) said ,a few options telling you what to do , knowing full well anyone with a bit of common sense would have already tried , a few months past and i thought it may get better and it did. Only because id gone out and spent 300+ for a new computer i was laughing up until it started after about 2 days .ever since iv tried everything but nothing is workin ....now for the past 2 weeks iv sent an email which no one has replied to so i sent another, again no reply every day for the past 2 weeks iv called them all i get is (were busy sorry please call back later) .iv tried in a morning in the afternoon and night, today i got through someone said hello then BYE,seriously i never spoke a word to him i just got bye and it hung up . Not 2 mins after i tried again and what did i get (sorry were busy call back later) to be honest i dont want to try again because il probably lose my rag and have a good go then they will probably hang up so either way i cant win . i pay my monthly bill on time and never miss a payment i keep getting emails offering me products to buy and then il get one asking me to upgrade the package now are they rubbing it in my face ,please i dont know what to do im in contract til march so i wont be able to disconnect as i cannot afford to pay up in full ,so im stuck i dont know what to do any suggestions anyone

hi , i am new to this ,but we had tiscal for a small office, not that much usage,i what a nightmare . we had a fault on our tiscali ,after three days of telling us that there was not a fault, tiscali finally admitted there was . then we were told that the problem was the router for three days ,finally we got an IT guy in to look at it and he was amazed at the lack of knowledge of tiscali help line " they seem to be working from a script " .result we kicked tiscali out.
on a personal note i am with pipex ,not the cheapest but easy to install and no problems , the help line does actually seem to know what they are talking about .seems you pay for what you get with broadband

Hi Swansegaz, thanks for letting us know about Tiscali Technical Support. Sorry to hear you've had such a nightmare through using them.
Is there anyone else who has had similar problems with Tiscali?
Keep all your postings about service levels and technical support coming in, we appreciate the comments as it gives us a better picture of what's happening in the market.

I was having speed difficulties with my broadband provided by tiscali and decided to email them. When you email them they send you a checklist of things to do, this email assumes that you have the IQ of Pete Doherty while on crack. The last resort is call their technical support line in Bangalore, or somewhere in India. The guy I spoke to went through the list again (just to bump the call charge up I think). I told him that I'd done all this and he then put me on hold for 10 minutes while he spoke to his manager. On returning I was told that they had found the answer to my problem and it was my firewall. I was told to switch my firewall off or uninstall it and then my speed would return back to normal.
I may as well leave my front door open to check my burglar alarm's working too.
