I doubt the bank will return the payment to the originators (they will see it as reducing their exposure to your overdraft) but you could try. Why don't you just transfer it over to his new account yourself ? That way you get your overdraft back and he gets some cash in his account. However, you look at it your joint net position will be the same though.

But if you've been paying the living expenses for the two of you whilst waiting for his money to come through doesn'tt he owe you at least some of his loan money (in which case the money is effectively in the right place) ?

Long story,

Basically my partner is due his student loan late, as they would not pay it into my bank account (had to be in his name) and he didnt have one. After finally being able to set up an account, we contactd student loans to get the payment (1070) paid to his account. We provided the acc and sort number over the phone and also sent in a form confirming the bank was his (had details of acc no and sort code, aswell as name, address, etc) and also a hand written conf fro, himself. Since this, my account has gone into student overdraft and owe more than the payment he was due. They have since received all this and paid the monies into MY account (even though they couldnt from the start and we advised of his new bank account). Since this has gone into my overdraft I have no idea if we can rectify it?? Is there anyway we will get this money back into HIS account seeing it is their error and they put it into an account they could not have from the start.
