Sofa damaged while being returned to seller...who is responsible?

    The carriers TNT - are responsible for any damage caused to the goods after they collected them from your premises and whilst in their custody, right up to and including handling at the point of delivery at the other end. (Did the recipient sign as damaged ?? ensure you also keep that email the recipient has sent... informing you the goods were damaged)

    You need the recipient to record the extent of the damage caused by the carrier and if possible photograph it. Meantime contact the carriers requesting a damaged goods claim form, then provide the carrier with all details of the damage and the amount of loss they have caused.

    Sofa damaged while being returned to seller...who is responsible?

    I recently purchased a sofa bed from a business seller on ebay. When it arrived it was not as advertised; it was manmade fabric, not leather, and was not the same shape. I went back to ebay but the seller had closed their account so I contacted Paypal and initiated a claim against the seller. The seller took a long time in accepting that I would return the sofa as I did not have the original packaging and they insisted they are within their rights to reject returns without this packaging (the packaging was plastic covering, no box and no named labels). I finally got them to agree to the return, by which time Paypal had withdrawn any responsibility for the claim. The sofa was returned, fully bubble wrapped and plastic wrapped and collected by TNT. However, I have now received an email from the seller stating that the sofa is damaged and the plastic covering ripped. If this damage is true, who is responsible for it? Thanks
