    Why not ask the housing ass if they want to rent it out via them?

    Even if you owned 100% (ie a proper leasehold) the property could be repossessed if you broke the terms of the lease. I would expect that evicting a tenant would be more likely than you losing possession though. You need to contact the housing assosciation to see what they would be happy with or you could take a chance and hope that they don't find out. The former would be more sensible obviously.

    Shared Ownership Properties and Sub Letting

    Hi, i currently own 80% of a shared ownership property, the other 20 owned by a Housing Association. I have been trying to sell my share for some time without any luck. I have now been offered an excellent job abroad and want to take the offer up and would ideally like to rent my property out while i am away. As i understand shared ownership legislation (and having perused my contract) it categorically states that vacating your property for renting/sub letting purposes is strictly forbidden and liable for grounds for H Assn repossession due to breach of contract.

    My question(s) are 1) does anyone know as to whether this type of case scenario has indeed gone before a court and if so what was the outcome 2) given that i own a majority share in the property would the H Assn have a reasonable case to pursue possession on these grounds 3) given the Governments recent views on strong property possession prevention would the H Assn even consider taking such a case to court in relation to the fact that they are supposed to indeed be 'social' landlords with a 'duty of care' to there tenants/joint owner partners?

    Any advice would be much appreciated........
