    Hi Netherfield.

    Do you want to publish the proforma of your letter so that others can use a similar format.

    A reduction of £20 is at least something. That's worth FIVE separate monthly changes for the cost of ONE old one. Surely some good news.

    Like the rest of you I have been done by this company. I'll put it down to experience for the phone etc., is fine and it is only a 12 month contract I signed.

    My job partially entails setting up mobile phone contracts and the one themobs offered was better than anything i could get through work. Probably should have realised that this was a set up but in hindsight etc.

    Seeing as neither Vodaphone or 3 are taking responsibility for their agents actions, and as the law stands, they don't have to, all I can do is my little bit at work.

    Yes it's a scam, we have all been suckered, yes I am annoyed, but I'll go back to a PAYG phone with an operator whom I trust.

    Tell your friends, families, aquaintances etc what happened and, together with the petition etc., something may come of it. Certainly confidence in Vodaphone/3 should be reduced.

    Hi Freddy,

    The details for request for information was published Jan 23rd and my letter you refer to was posted on 14th March. However, here is the latest twist - I have found that service providers have 12 weeks in which to agree a settlement of a complaint before you can go to arbitration. However, note that on Ofcom' website you can fill in their survey as a way of complaining although they won't take up individual complaints as such. I am guessing that - If they see enough people complaining via the survey they may be inclined to do something but don't hold y6our breath!.

    It seems that "Three" are making money by enforcing mis-sold contracts? Is this legal?
    There is no chance of a refund from "themobs.com" due to their voluntary liquidation. Has anyone had any results from Trading Standards or other avenues of recourse?

    No nothing yet, its a shame the governement are *** and the LAW!! UK has too many options in which you can screw the people, thats whjy there is too much crime in UK and frauds..im *** OFFF!!!! im owed £400

    Have been in touch with BWC Business Solutions who were joint liquidators of the mobs.
    They inform me that due to insufficient assets of the mobs it is not anticipated that a dividend distribution will be paid to the unsecured creditors of the company.
    well & truly stitched up....

    Dear Richard,

    Like many, I will not be receiving my cashback from themobs.com. I took out my contract with 3 because of the attraction of the cashback deal. Without the cashback incentive, I (and many others) would not have taken out the contract as it was certainly not value for money. This company acted as an agent of 3, recruting customers for them and 3 are now totally absolving themselves of any responsibility for this situation.

    I find 3's behaviour totally unacceptable. I have cancelled my Direct Debit with them and they are now harassing me for payment, threatening to send 'collection agencies' to my property and report me to the credit agencies. If you, or anybody else reading this have taken, or are planning to take similar action, please contact me at vivthejack AT hotmail.co.uk, as I feel 3 will be more receptive to larger numbers.

    I find it hard to believe that 3 can get away with paying this company to recruit customers, detach contact with the company at the first hint of trouble and then stand by as these customers are cheated out of their hard-earned money.

    Hi Viv.

    You're on a sticky wicket if you cancel your direct debit with 3.

    The contract is with the Mobs.com (Mobile solutions) who supply the mobile phone.

    3 just supply the network. By cancelling your direct debit because you won't get your cash back (like me and many others) to try and get back at the Mobs.com is actually targeting 3, who in their eyes have done nothing wrong, they are still supplying you with a network and allowing you to make free calls according to the tariff you chose.

    Whether there is a direct link between the mobs.com and 3 would have to be proved.
    I would suggest you re-instate your DD.

    "I have been unable to obtain the contracted refund from your agent trading as "Themobs". Your customer services referred my query to them, but they are no longer trading and cannot be contacted. I am told I cannot change my contract - which in my opinion was sold fraudulently - without incurring an unreasonable charge of £25.
    It is clear that you were aware that your agent "Themobs" were abusing their position as far back as 2005, yet you continued to endorse and profit from their malpractice throughout 2006.

    I believe you should allow customers to change to the lowest available tariff immediately and without charge."

    (though I wonder whether I'm just "*** into the wind").

    Something has hit home somewhere - I've just had a call from 3 - they have allowed me to change my price plan down from £35 to £30 per month, no fee, and I can do it again next month - and for the three months after (i.e. four times).

    Hi Freddy,

    I too like everyone here have been conned. I got 2 contracts one for myself and one for my partner. 3 are completely denying any resposibilty, the only thing is... I dont recall ever signing anything with 3. I applied for the contracts with themobs and did not receive any t&c's for 3 at all. Surely a contract has to be signed by both parties for it to be legal.

    Please correct me if I'm wrong in thinking this.

    I followed S1B's example and put my complaint through the feedback link yesterday, and got a call from 3's Indian call centre today.

    The lady I spoke to just recited their given spiel about reading your contract blah blah and refused to reimburse the £25 for tariff change.

    I insisted on talking to her manager, an Indian gentleman calling himself Craig Payne(?), who also just quoted the 'read your contract' mantra, and said " no we wont reimburse you".

    I'll try again in four months when my contracts nearly up. Got a bit more clout then.

    Hi 

    After a lot of toing and froing with Customer Sevices I got my contract downgraded from £37.50 per month to £25 per month at no cost. I did cancel my DD and subsequently reinstated it when we had come to an agreement. I would be very careful before damaging a clean credit record.

     I will stick with it until the contract ends (August) then review the situation which I can do a month in advance.
