    Thanks. I got stung recently with Cool New Mobile aka Mobile Affiliates who went into administration in November 2007, so I have lost out on my money. I have registered with the Administrator and hope there may be some results in the future but I doubt it. I am thankful however that the company is now defunct and they cannot cheat any more customers like us. There are lots of cowboys out there and the only reliable ones are those who have retail shops in the high streets. My partner was more fortunate as her contract is with Buy Mobile direct and she have received her first cashback and due to receive her second cashback end of this month. Finger crossed, this company will remain reliable.

    The problem with these companies is that their offers are flawed in the first place and are doomed for failure. Their offer is based on them not having to pay out to customers due to 'errors' in the cashback claims. That is why they constantly change their terms and conditions and imposed strict dateline and ridiculous conditions for our cashback hoping against hope that you would not be able to comply and hence they do not need to pay out. Absolutely a rip off plan and I am surprised that the government allowed such practice.

    So there you are, perhaps we need to replace the current government!

    I am warning everyone. Do not; not; not to get any phone from THE MOBILE OUTLET. They are really, really cowboy and rubbish company. They never, never issue you cash back cheque, even you said you already contacted Trading Standand, Consumer Direct and Watch Dog. Of course, you comply therir T&Cs. They do not care at all. I would said they are going to run out cash and might be going to be closing down.

    Hi AliJ

    Sad to say, these companies adhere to strict T&C for their cashback as they have set these deals to work base on customers not following the T&C and the constant changes of T&C without prior information to their customers. And that is not ethically and legally right.

    I had a contract with Cool New Mobile aka Mobile Affiliates aka Phonebox direct which operated under this principal and last week they have gone into administration as such we are unable to even think of getting our money back. The network have allowed me to reduce the contract however the latest info from Rob Barnes was that we can approached the network provider  again and each case will be dealt with case by case.      As for BuyMobilePhones.net, my wife has informed me that they have banked in the money on the 16Nov instead of 11Nov and the money arrived in her bank account yesterday. She is due to send her second claims next month as such finger crossed, she will get her money back. She had prior to sending her claim forms, downloaded the T&C from their site and emailed them for the correct instructions so her claims were accurate. Mine was accurate too with CNM/MA but now that they are in administration, we can only hope the network can do something for me.

    The government have pulled in all the network providers with regards to the cashback scheme so I would suggest you call up your network provider to either cancel yur contract or get them to pressure Buymobilephones.net to honour the cashback even though the mistake was yours.

    DONT USE MOBILE RAINBOW!!!  Put the claims in ok.  They paid the first one after some phone calls and threats of court action.  The other two claims have not been paid.  They keep telling me they will hasten the payment but still no money after months of waiting.  No suggestion that I have done anything wrong when I submitted the claim.  THEY JUST REFUSE TO PAY!  Sent letters threatning court action.  That is the only option left.  Anything else I should know before I complete the court claim on line.  Anyone else in the same boat?

    I have just had exactly the same problem as above and don't know what to do. Spoke to Trading Standards who advised that I should try by writing a letter first. I had such a poor and rude response from the company and was hung up on twice by a customer service advisor. All I wanted to know was how to appeal the decision as I felt it was very unfair as it was only that I misinturpreted their documentation which obviously you did as well.

     I was told that I had one chance and one chance alone. I felt very upset that I was not advised that I had made a mistake and given the chance to rectify it instead I only found out once I chased up what was happening. I also felt it was very unfair that all claims are now not claimable.

    Will write a letter but don't know what else to do from here other than tell all the people I know never to trust BuyMobilephones.net.

    Unless you got your phone via the mobs.com and they close there web site dont answere there phones and the 3 network tell you that the contract was with them and not 3 network end result no leg to stand on and 1 years line rental out of pocket .

    Hi, i have just been informed by THE MOBILE OUTLET that my second cash back claim was late so that one and the rest are cancelled my bill date was 24 sept so they should have received it by the 15 Oct i did not receive the bill until the 5 Oct due to postage strike and i sent it to them on 6 Oct by 1st class recorded, but it was not received by them until 16th Oct again due to postal strike.  has anybody any ideas on this, i have email them and tried to telephone them but after waiting ages on a 0870 number they put me through to wrong department 3 times now and tell me to ring back and ask for cash back department.  i am now considering the small claims court, but not sure if its the THE MOBILE OUTLET or the post office i should claim against

    Hi  I am having problems with phones2udirect cashback claim. I have sent in my claims at months 6 and 9 and not had either. Both sent recorded delivery, letter of complaint sent to MD of company and loads of emails sent and all they ever say is your claim is being investigated.  Does anyone know what the letter is using the Consumer Act 1967 as a means to getting them to take action  and pay out ? I'd be grateful for any help. Thanks

    Sorry i disagree teeljayl i took out a cashback deal with THE MOBILE OUTLET the first casback was delayed by two weeks. in the T&C it states 28 days. my last claim was the 20th Sept they recieved 21st Sept as i send them recorded delivery, on the 11th of Oct i recieved an e-mail excepting my claim saying there would be another delay, despite e-mailing three times with NO response on Tuesday 6th Nov i telephone and was told it would be in my bank no later than Friday. I shall be phoning them again tomorrow as it still isnt there. my point is they are very strict when it comes to the T&C however they break them to suit themselves with not even an appology. i am due to send my next cashback next week so i dont hold my breath as to recieving that on time. this is my first cashback deal and i shall not take out another to much hassel.

    STAY CLEAR OF MOBILE OUTLET THEY HAVE ALWAYS GOT A BACKLOG OR SO THEY SAY

    Having had a problem with CoolNewMobile very recently, I would give the following advice.

    Follow their T&C's that applied when you took out your contract to the letter.

    Copy all the documents you send to CNM

    Photograph the documents with the envelope before you put them into the envelope.

    If possible get an independent witness whilst doing the above.

    Send Recorded Delivery

     

    If they still try to invalidate your claim issue a Letter before Action and then sue through Moneyclaimsonline. They will back down before court.

    I agree with you on following the T&C and I usually do and never seemed to have any problems getting cashback from the reliable and established companies especially companies that are subsidiary of the big companies e.g CPW, etc...whom I have used over the pass 3/4 years  However I have recently been sting by a rogue trader ; Cool New Mobile or Mobile Affiliates (recommended by Moneysupermarket on the site early this year). All my docs were in order and confirmed by CNM/MB by email 3 xs. however the cheque did not appear. When I chased them for the cheque after 15 days, they claim that my docs were incomplete. Fancy that, after they have confirmed that the cheque is being issued (this was for my 1st claim submitted in August! - it took them 2 1/2 months to decide that my claims was now invalid even though they have confirmed everything was ok over the period of  2 1/2 months). If my forms were incomplete and invalid, they would have told me immediately when they received in the 1st week of August). I believe that someone in the company have decided that they do not want to pay out to customers so they decided forms are invalid. I am going to take them to court and demanding for my money back if they do not reply to me by 30 Oct.

    So it is not just the T&C, you need to watch out for the Rogue Traders as well. Checked them out - Cool New Mobile/Mobile Affiliates. Apparently how they are doing it is by changing their T&Cs regularly online without informing their customers and adding on new rules and regulation that supersedes previous contract signed four/ five months earlier, and all that without informing their customers. DON'T JUST FOLLOW THE RULES but only use cashback companies that are subsidiaries of big mobile phones companies! That is the lesson I have learnt!

    Hi there

     

    No need to write a post as I am at the same situation. I would say it is a bit my fault as I did not read the T&C( whether they have sent them out is other question) . personally I think it is a fraud as they dismiss the current claim and any subsequent one...I have said that I will notify Trading Standard/Consumer Direct but I do not think I will be able to get any money.

    With regards to different companies I had few contracts through Dialaphone and I never had such a problems nor when RAF(Reccommend a Frend Scheme) was due to be paid. I deeply regret I did not go back to them..

     

    Any advice about buymobiles.net..

    The above about the court not hearing your caser is absolute crap. Seems like "Cat" works for the scum.

    The terms and conditions of your contract were unfair as they have not allowed you to remedy the situation:
