    From my knowledge of employment law there should be a process through which all employees affected have to go through. If the process is not seen to be fair, you could potentially make a claim against the company.

    Regardless of how big or small the company, they can't just play fast and loose with employment law. They are either terminating your employment with immediate effect (which depending on the terms of your contract may be illegal!) or they are paying you for your notice period.

    They can't have it both ways.

    Read up the terms on your contract, you could well be being short changed here.

    Thanks for your repsonse.

    No i will not being getting paid for these 4 weeks, which I dont really understand, it is quite a small company and they are not really up to date with all the employment laws.

    I have also read that because I get paid montly that I am entitled to 4 weeks notice, do you know if this is corrrect.

    Right. If your employer has not issued you with a formal notice of redundancy (which is doesn't sound like they have, as they have set they'll "let you know"), then you appear to be on what is called "Gardening Leave". Your employer is required to give you a minimum notice period before termination of employment.

    This has to be done in writing and must be legally correct. If they have not given you formal notice of redundancy, then they must give you the minimum period of notice before they can terminate your employment (unless you're being fired).

    Look up the terms of your contract. It will state in there, the minimum notice they must give you in writing before you can have your employment terminated.

    As for the whole time worked thing, your time worked does not cease until your contract has been terminated by the company.

    I have a question though, are they paying you during these four weeks?

    redundancy help??

    Hi,

    I am being laid off as there is not enough work for me at the moment, my employer has told me he will let me know in 4 weeks if I will be made redundant or if there is work for me to come back to..

    my questions are.. i have been at the company 2 years 11 months and 20 days so am i still in employment when i am laid off bringing my employment up to 3 years by the time the 4 weeks are up? and what kind of payment will i be looking at if i get made redundant and will i lose any of this entitlement if i choose not to come back after the 4 weeks??
