    You have insurance, you were involved in an accident, report the accident to the insurance company formally, making a claim for repair etc. Currently this series of calls will only lead to further agrivation and will not result in the claims assessor reaching a decision on the fate of your vehicle. Should the insureres subsequently write it off it will become their property and their problem. So claim form and send it recorded delivery. Responsibility for the accident is a secondary issue.

    Recovery fees - my responsibility?

    Hi all,

    This is my issue. My car was crashed into by an HGV on the M4 West motorway over a month ago. The car was rendered undrivable and I was told the highway authorities would remove the vehicle and charge me if I didn't get another car company to remove the car.

    The highways guys did give me the details of another company who removed the vehicle and placed it in storage, and advised themselves that they'd 'let the insurance guys take care of this.

    When I got home it was quite late so left the phone call to the insurance company to the following morning.

    I asked Admiral, my insurance company if they would cover the costs of storage and recovery, they advised that, as long as I was found to be in the right and it was the other parties responsibility, that the costs should be covered by the party who was liable, so I left the car in storage.

    It's been a month and four days now, and they passed the case onto Albany and I quizzed Albany about this on receipt that both of my witnesses confirmed that I was not at fault. Albany have since informed me that 'We will try to claim for this' but they have sent me a letter saying 'it is your responsibility to pay for all storage/recovery costs and we reccomend you move the car to somewhere that does not charge you for storage'.

    How can they do this? Due to their own delaying the case, the costs on storage and recovery of the vehicle exceed £1,000. The vehicle's worth is £800.

    Can I please get some advice on this, as I really don't know what to do, but surely insurance companies exist so you can claim damages that you have incurred at someone else's mistake, and for this very reason it seems wrong for an insurance company to refuse to claim for this.

    Equally, Albany did offer to claim for lost days at work, but they refused to do the above.
