    Debt companies have to provide evidence of the debt, so as maxsteam advises, just tell them that you are happy to go to court, as so far they have not provided any evidence that the amount is due. Ask them to supply evidence from 02 as you have not received any letters from them advising that money is outstanding.

    If you are sure the 02 debt is wrong, enter into a complaint with 02. asking them to furnish you with statements to show why the amount is due. Thia should confirm the date of the last payment and if over 6 years has elapsed, the debt may be statute barred and therefore unenforceable in court.

    Check your credit records with Experian and Equifax to see if this is noted, so you can get the records corrected if wrong. Both these credit references companies offer free trials if you remember to cancel.

    Assuming that are comfortable standing up in court and saying that you don't owe any money on an old O2 contract, you should encourage them to take the matter to court so that things can be concluded. When it goes to court, you should attend and you should take details of the correspondence that you mention.

    Hi

    Hopefully some of you can advise me on this situation.

    My wife has recieved numerous letters from a company we have not heard of before called Lowell, they are asking for money supposedly owed on an old o2 contract to the tune of £191.59. They have said they will be starting court precedings against her if she does not pay in 7 days. Lowell has not provided any proof of there ever being a contract or bills from o2 all the have provided is a very basic spread sheet with random entries of numbers. In my opinion this does not consist as proof of the money owed. After requesting further proof all they forwarded was the very same spreadsheet.

    We would like to know where we go from here, Lowell say they are unable to provide further proof of any contract or o2 headed bill.
