yes thanks mate i will find out what she said to police tomorrw and keep you informed... i think your right she must of just taken the number plate....if i explain to police what happened we both decided to leave it and i tell them to view the car do you think they will take me to court? its such minor scratch, just gettin ideas, surely common sense would prevail...

My gut instinct on this is as follows. By the Monday when she had decided to claim, after phoning her Insurers she realised that she needed to advise the Police. I take it she did not have your Insurance details, so this maybe the reason or perhaps the Insurers needed the Police to be informed if Personal injury is being claimed for. So she made up the story that you had left the scene of the accident. My advice is just to play this straight and if necessary get your brother to provide a witness statement. I don't think you have too much to worry about. If there is no CCTV, the Police will not be able to do anything. This is purely a case of her word against yours. I would think that the Insurers could decide on a 50/50, so it will affect each of your policies. This depends on how the accident is described on the claims form. As I said before, you could claim that her car was moving at the time and there was a coming together. Huckster

Huckster went to the car park and asked workers, there are not any cameras..... I didnt run off, we both got out the car, and saw no damage thus both decided lets leave it, (Very very minor scratch)...I parked the car literally 3 yards from the incident and got out and she parked in about 20 bays down. I stayed there and walked past her in case she changed her mind but she wasnt botherd as she was getting kids out and i think she went to town centre as when i got back an hour later her car was still parked there. Now what i dont understand is why claim to police i ran off, this is totaly madness, Im going to police station tomorrow explain to them what happned, show them my car and no damage and i hope they see sense. Its so frustrating people trying to make false claims, it happened on Sat and she reports it Monday lol which is a joke...I hope theres some cameras showing me pulling into the road and then pulling out the same way an hour later which would clearly show i didnt hit and run! Any advice huckster? You been good so far, also any one else experiance this?

If the Police have been in contact I would go to see them and provide your side of story. The Police may get hold of the CCTV from the car park if they can be bothered to follow this up. I doubt it!!!!. This is a private argument between you and the lady in question. It is one persons word against the other.
This is apparently the score legally. - Is anyone (other than yourself) injured?
- Has there been any damage caused to someone else's property, or another vehicle?
- Has an animal (other than any you were transporting in your vehicle) been killed or injured (for these purposes an animal applies to a dog, pig, goat, sheep, ass, mule, horse or cattle.
If any of the above points do apply, you are legally required to stop at the scene and remain there for a reasonable period of time that will allow any people involved directly or indirectly in the accident to come to you and request your contact details. If you are approached by anyone who has reasonable grounds for requesting your information (someone involved with the accident, or who owns property that has been damaged) then you must supply to them your contact details (name and address) and if you are driving someone else's car, then you must supply the contact details of the registered owner too. If you don’t leave your details at the scene, then you must report the incident to a police officer or at a police station as soon as is practically possible – and in any event, within 24 hours. You can ring to advise the station that you are coming to report a road traffic accident, but it is not acceptable to report the incident over the telephone – it must be done in person. Hope this helps. Check out the CCTV in the car park. If the accident was filmed and you provide inaccurate information to the Police, you may come to regret it. Huckster

UPDATE: The women is has reported it to the police that i have hit and ran off!! I have rang my insurance and explained she went into the back of me :-) but i think the police case is separate, what do you guys think i should do? i am thinking go police station tomorrow explain to them what happened, show them my car and that there is no damage except such a minor scuff.... What do you think anyone have any experiance of this????

thanks huckster, its just so frustrating as there was nooo damage at all. I will call insurers tomorrow and see what they say i guess, i dont know what else i can do. Maybe i should go check the carpark see even if there is a camera there and i will say its 50/50... I should have taken pictures with my phone, what if i got her details through insurers and took pictures of her car? its obv she is going to try accident claim, i want to have my story straight thats all. Anyone with ideas do help i appreciate it

You could make a request under Data Protection for a copy of the surveillance camera tape, but you would have to supply your regsistration, date/time, which part of the car park and which camera. If you check the car park there should be details on a sign of who you would need to make the request to. It will cost you £10 which is the maximum they can charge you for such a request under the DP act. In your statement to Insurers, you could say something along the lines, that you believe the other car was moving at the time and that it was a 50/50 accident. It may take some time to get hold of the camera tape, if it actually shows the event. If you made up a total lie that the other driver was responsible when she was not, you may be caught out if the Insurers did get hold of the tape at a later date. Huckster

Hi You should always report such accidents to your Insurers, so you can give your side of the story. This is important as third parties have a habit of suddently finding that they have been injured. I bet they have mentioned this down the pub to a mate and they have been told it would be daft not making a claim for personal injury. At the moment people are short of money, so this accident could be like winning the jackpot. About £3k for a bit of whiplash. Difficult for a doctor not to diagnose if they can act out the symptons. I bet you this is what they are up to. If not perhaps that they have since seen a bit of damage to the car, that was not noticed at the time. You will find out tomorrow. Post back with the details. You should stop worrying until you have made the phone call. If you have the other driver's number, you could call there first and point out that any small insyrance claim will result in a disproportionate increase in both your premiums.

Hi Please can anyone help me? On Sat i slightly reversed into a car in car park, we both checked the damage and there wasnt any so we both decided to leave it.Today i got a call from insurers but missed it, they left me Voice Mail saying third party allegation in an incident taken place...I will call them tomorrow but what do you think is happening?? Do you think she will try to claim damage when there wasnt any? Also the owner of the car is my brother and he got a letter from police to verify who was driving. What do you think she is trying to do? and what do you advise me to do? or do you think its someone else reported me (third party allegation?).... Please help :-(
