    Re: Phones2udirect cashback problems!!!

Just another update, I've been informed that they have gone into liquidation! (Great, hey?!) so it could take a couple of years to get the money back, that's if I get it at all. If anyone is in the same position as me and has success getting their money back, will you let me know?

    Many thanks,

    Laura!

    Re: Phones2udirect cashback problems!!!

Thanks to everyone for your advice so far. I went to the CAB and they told me to contact Trading Standards, so they are trying to sort it for me. As they have told me, they have no power to guarantee payment, but can make it known to P2UD that I've made a complaint and hopefully get my money back!!

I'll let you all know if I get any joy from this route, if not I might have to go through Small Claims Court as you suggested. At the moment, I can't even think about that though, I'm a student with a dissertation to write and I'm still deluding myself that they will just decide to send the cheque out!! hehe!

It's 8 months since I ended that contract, so maybe it will all be sorted within a year?!

    Thanks again,

    Laura!

Don't hesitate take them to the Small Claims Court. It is easy you can do it on line "moneyclaimonline" It costs £50 but you get that back if (when) you win the case.I have just been awarded the full £420 + £50 (Swansea County Court anthony anderson versus phones2udirect 22/01/08"The case will be transfered to your local court and P2u will not bother turning up.
It is important to explain to the district judge that you could not ascertain whether P2u had received your cashback submission within the 21 day permitted period as they require a minimum of 55 days to confirm this .Their own web site states this fact (download it) Also explain that they do not accept properly authenticated copies of documents therefore if a submission is GENUINELY lost in the post or a document is said to be missing the consumer has no means of retrieving the situation.(again down load this paragraph from their web site).P2u's Terms & Conditions were deemed unlawful by Judge Christopher Lethem at Tunbridge Wells County Court (August 2007) being in breach of "The Unfair Terms in Consumer Contracts Regulations 1999". Download section 5 of these regs. Armed with the above you will have no problems obtaining judgment in your favour. P2u are regularly losing small court claims .The Judges are fully aware as to what is happening and are only to pleased to try and put these disgusting companies out of business. One word of warning do not accuse P2u of deliberately losing documents as this is not proveable and the Judge will not entertain it.

    Best of luck

    Tony

    Re: Phones2udirect cashback problems!!!

    Hello,

Don't give up keep trying. I managed to get my first two claims by sending them letters with a threat of taking legal action. I am still trying to get my final payment from them. Threat is the only language they understand. Give them a deadline and if required go to small claims court but don't give up. In the end I am sure they will pay..regards

    Re: Phones2udirect cashback problems!!!

    Hi

I am afraid i can't offer help but I am pursuing my 1st claim still through this company and my 2nd claim is due to go off when my next bill arrives in the next few days. I sent my claim recorded delivery on 25th July and i keep emailing  then and just keep getting fobbed off with replies saying we are looking into your claim. I have phoned and also foind no one will speak to you about cashback or complaints. I sent an official complaint letter 3 weeks ago and haven't had a reply to that either. I am getting so frustrated by these people and don't know how to go further with my claim though i don't intend giving up ! Sorry i am not able to help , just thought i would share my experience . Please let me know if you get anywhere with them.

    regards Red

    Phones2udirect cashback problems!!!

I took out a contract with 3 through phones2udirect.co.uk last year.  It was a 12 month contract offering 12 months free line rental through cashback.  I followed the terms and conditions, sending my first claim special delivering and my second and third claims recorded; I therefore have proof that they did receive my claims on time.

I have e-mailed the claims department numerous times through their website and have only had automated responses every time.  They do not speak over the phone about cashback so when I did try to ring there wasn't a department to speak to!  I even enclosed a letter in my final cashback claim asking them to contact me and they haven't.

I do not know what else to do as I can't see what I've done wrong and I have never been told by them that my claims were unsuccessful as I thought they would if I had done something wrong.

I have lost £420 from this so would really appreciate some help!

    Thanks, Laura.
