I agree with all you said....they are a bunch of imbeciles and they really make customers angry. I took 4 hours just writing bad reviews in the hope that these cretins go out of business ASAP

hi. i have been having a stand-off with tiscali since january when i moved home. for some reason they switched my broadband to my new house and number but not my calls. they were left on the old number. so not only was i having to pay BT for calls i should be getting free with tiscali, but i was paying for calls being made by someone who had my old phone number, that didn't qualify for free. when i reported this i was told to send my BT bill and they would look into refunding my call charges, but this would be unlikely because it was my fault. HOW THE HELL WAS IT MY FAULT?? i was then told that they had a note on their system that said i had personally rang BT to request i pay them for my calls (as if they would have that info) and that they had record of me phoning tiscali advising them that i wanted my calls with BT but would still pay tiscali (as if i would do that!!) anyway, they conveniently lost my BT bill

Ive had issues with extremely low speed on my 8mb line, they blocked peer to peer (even legal bit torrent downloads i was paying for) then when i complained despite them claiming to know nothing only connected me between 3am and 6am. I am not a big downloader so i dont understand why i would be capped. I sure dont use the allocated 30gb a month Then when i kept getting dns errors when trying to connect to the internet i decided to migrate. I phoned for a code and the next day one was sent out via email. I didnt act immediately as i decided to research new companies and when i found one i liked i returned to my email for the mac code only to find that it had mysteriously disappeared from my inbox. I emailed them about this and they claim they had no record of having generated a mac code for me so I have to phone again but as their offices close at 6pm this is difficult for me. I dont understand why they cant just resend the mac code but obviously they are denying i ever contacted them in the first place.
The woman on the phone argued with me when i tried to leave saying that i would be forced to take out an 18 month contract with any other supplier even tho i tried to tell her the company i had chosen didnt have this kind of tie in (its three months max) she was telling me i was wrong and foolish for thinking this, she also told me id have to pay expensive connection fees despite the other company telling me i didnt. She wouldnt listen to me when i said i had researched this and was extremely condecending. Im really annoyed with this service as it was fine for almost two years prior to this. Thanks to the people who provided watchdog information above i think i shall be using this.

I'm reading horror stories throughout the Broadband forums. In a situation as bad as reported I would have no hesitation in taking the *** to Court. I first took BT to the Small Claims court for bad service and have followed up with two more. I have won all my Cases. In BTs case, they were a no-show and the judge asked if I was sure I was claiming enough! It is immensely satisfying to win compensation for lousy service from the big guns. Malctrader

Hi - can you give us some more information on how you built your case against these companies and exactly what you took them to County Court for? I am planning to sue an IFA for negligence over the sale of a policy to myself and would welcome more details - and who else have you successfully sued?

Hi fotasmic, First, you are walking in difficult pastures if you are contemplating a Financial Services action. It would be essential for you to exhaust all avenues via the Ombudsman and possibly other channels that I would not be aware of. If the Ombudsman gives you the thumbs down, it will have cost you nothing and you will have a pretty strong indication of your chances at litigation. On a general note, however, the crucial elements for me are complete, accurate and, wherever possible, contemporaneous notes of every single event in the dispute, including copies of all correspondence and a log of all phone calls, including key statements made during those calls. Dates, times and names of the other parties are all valuable. I will not give you details of the other Cases, but one was a Cruise Line and the other was an Enforcement Agency. In all cases, I prevailed because I had complete and accurate documentation and records and the other parties did not. In all Cases, I found the Bench/Judge to be exceptionally fair, courteous, patient and willing to explain some of the legalities that you or I would have difficulty with. Hope this helps. Good luck. I cancelled my Tiscali account in May 2007.(by phone as it's the only way they allow) I now have a debt collection company hounding me, Tiscali didn't cancel the account as promised, and suprise, suprise they can't find a record of the phone call (i have a phone bill recording a conversation I had with them 35mins worth. They still say they have no record. Anyhow, Im been taken to court for the 15 money I owe- according to them .. If anyone out there has any similar experiences could they please let me have details to support my case. HI TeeBee. AREN'T THEY A BUNCH OF MUPPETS!!!!!! i cancelled my tiscali direct debit in june as they messed up my account and made making any changes (package etc) impossible. they have continued to charge me since even though my account has not been used since june. i rang their billing department yesterday to make sure they had received my cancellation request (suprise suprise they did not have record of this. they are good at losing info). anyway, i demanded i spoke to someone who actually had a clue about what they were doing. i spoke to a guy who was really helpful. apparently, if tiscali fail to receive 2 payments, your account should be suspended automatically. this means that i should only owe them £40. i bet they would have happily accepted the £180 if i had sent it!! anyway, in tiscali's code of practise, it tells you that you can only go through CISAS (ofcom approved ajudicator) if they agree to it. but this is not true. you can go through CISAS after 12 weeks whether tiscali like it or not. it should never come to the point where debt collectors are called!!! Tiscali also think that a contract is one sided. they forget that it is between 2 parties. both have things they have to stick to. if a consumer doesn't pay for the service provided they are in breech of contract. (contract is suspended) if TISCALI fail to deliver the service YOU ARE paying for, it is breech of contract. (contract SHOULD be suspended). but tiscali think that you should pay the money and let them screw you around for 12 months and that is ok because they are a big company. but it is not true. just look on the web forums (even tiscali's) and you will find a whole host of people who have taken them to court and won. i am amazed that tiscali is so popular., i have only seen a couple of good reviews for them but hundreds of bad. if only people read reviews first!!! BOTTOM LINE. TISCALI IS A F'N JOKE OF A COMPANY WITH A POOR SERVICE AND EVEN POORER CUSTOMER SERVICES (IN INDIA). THERE ARE PLENTY OF OTHER PROVIDERS OUT THERE. MAYBE THEY ARE A POUND OR TWO DEARER A MONTH BUT TRUST ME, THIS WILL NOT BE THE CASE AFTER YOU HAVE PHONED THE MANY 0845, 0870 AND 0871 NUMBERS YOU NEED TO BECAUSE THEY ARE SO USELESS.

I had a nightmare with Tiscali....so when my contract expired, I switched to Pipex.....and guess who bought them recently? Tiscali! Pipex (or is it Pipali or Tiscalex?) have one of the worst customer services departments I have ever come across - even worse than Tiscali and guess which department Tiscali cut back on once they bought Pipex? (Like they can afford to cut back on customer-service) If there's one thing I've now learnt (and I am dumb for having made the same mistake twice) don't go for the cheapest, (after all, the ISP's all offer similar levels of speed/ download usage etc) go for an ISP with a good customer service reputation. Tiscali and Pipali/Tiscalex don't care about customers - they accept high customer churn rates, because they'll focus on impressing the City analysts with sign up numbers.

There IS something you can do. You can sue them in the small claims court for the money they have taken from you. Write them a LBA ( Letter before Action) setting out your claim. Dont forget to include additional expenses like postage and phone calls you have made. Give them a two week deadline to meet your payment and make it clear you will have them served with papers from the County Court.. Then wait and if they dont pay you go ahead and make your claim. If you google small claims you should find out what to do. You wont be making much but it will be a moral victory as they would not be able to defend such a claim, nor would they employ legal advisers as it would not be worth their while. Good luck and dont give in - thats just what they expect you to do.
