    NicE:

We believe the CCJ has been wrongly issued but what should we do about it? How does he prove that it wasn't him who missed the payment?

You can contact the court (probably your local court) and apply to have the CCJ cancelled.

The form you need is N244 (read the notes at the end first)

    Mortgages and CCJ's

Help please! My husband and I have recently applied for a mortgage, we are not first time buyers and are both in secure employment. We have had the mortgage application turned down and have been informed this is because my husband is shown as having a CCJ against him. He knew nothing about this as our previous mortgage was just in my name. He has checked with Experian who explained that a utility company has registered the CCJ for an unpaid bill from a previous address he lived at. The CCJ was registered in 2006.

I dont know how long it takes to register a CCJ but my husband hasn't lived at the previous address in over 6 years since he moved in with me and we have been married since 2005. We believe the CCJ has been wrongly issued but what should we do about it? How does he prove that it wasn't him who missed the payment? We are really worried that we will lose out on our future house because of the delays we may face in clearing his name. We would appreciate any advice on what our next step should be and how easy and quickly we might resolve this issue.
