cashback more like nothing back, its a total sham! although you gotta give it to the companies for thinking of a genius scam like this, they never send you your cashback, and appropriately lose your bill or say it was late, stay well clear!

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

I had taken out a 12mth contract with mobile rainbow on 20/1/07 & still have yet to receive my first 6 months of cashback as mobile rainbow are disputing that I had sent them 7 months of bills despite only posting out the first 6 bills only (as per their terms & conditions). Their customer services line is difficult to get through today as the recorded message is going in a loop.

I would strongly recommend that people stay away from their cashback deals.

I have had 11 mobile contracts using cashback deals and 6 of these with the Carphone Warehouse (and through Onestopphoneshop which is owned by Carphone Warehouse) and have had no problems at all with them paying out the cashbacks.
Mobile Rainbow and Phones2U Direct however have not honoured the deal.
I've bought 4 through www.freecontractohonedeals.co.uk which and they paid out with no problems.

Well done cat, yes I think you are right. If you follow all the rules within the agreement then thay do pay out.
I have 6 of these contracts and ALL of them pay out without any problems. I think this is due to keeping within the contract.
I do believe that there are cases where people have problems but if you look deep down into the problem then you will mostly find that some part of the contract has not been kept by the person who took out the contract. Please remember that it is a contract that you and the company have to keep and if one rule is broken then one looses out and one gains.
Sorry to have been so frank but that is what you signed up for, and if you did not keep to the contract then sorry you lost out

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    Dear Sir,

These cash-back mobile companies are offering cleverly designed very “attractive” offers and the most of the terms are conditions look easy but are purposely designed in away that there is huge possibility of missing out or to not to meet such strict terms and conditions for the cash-back. And these companies are ripping out thousands of customers every year. I can’t understand why police and law enforcements agencies don’t stop this “white collar” crime.

My first contract was with http://www.dialaphone.co.uk/ and fortunately I managed to get my all money back from this company. Due to this pleasant experience, I signed two contracts with http://www.onestopphoneshop.co.uk/ and me and my friend signed one contract with www.themobileoutlet.co.uk each. I sent all bills and cash-back vouchers in time to onestopphonestopshop (which is basically part of car phone warehouse) but still I didn’t receive my two of cash back claims. They have lot of excuses to rip their customers off.
I and my friends have terrible experience from the http://www.onestopphoneshop.co.uk/. We sent them full six months bill but they said they didn’t our actual 6 months bills but what they were looking for is, our line rental bills. As I mentioned earlier, Cash-back terms and conditions are purposely designed to deceive people and rip their money off. If responsible agencies didn’t work in time to eradicate such “white crimes”, these companies will continue to rip innocent customer and trust on corporate sector as a general.

    Regards

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    The legal process?

Well, if you think that they have breached their agreement with you, then you can sue them for specific performance of that agreement, or damages for the breach thereof (the latter, I would guess, is the likely more lucrative one).

But, you see, these cashback deals are fiendishly clever. I had one from Phones4U, and it paid out, but only because I followed the agreement instructions to the absolute letter, and sent my correspondence via registered post.

Similarly, I had an interest-back deal on a loan, which I also followed to the letter, and it paid out over £2k - it can be done!!

So, before you try and recover any money, make sure that you definitely did do everything that the deal required you to do. I am not suggesting that any of you failed to make a proper claim, only advising that you be certain that you did, IYSWIM.

Good luck with it, all of you.

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    Hi Martin

Over the past few months I have been thinking about this the issue you have raised, the Carphone Wharehouse has cropped up in most of the conversations I have held.

Unfortunately for yourself I don’t think anyone will pinpoint the problem to a single company for example the CW, partly because nobody knows the details of everybody else’s transactions (the people who don’t get check back as they are supposed to), and also because the people who are most likely suffering from the problem are people with limited legal knowledge, therefore are scared and don’t want to have any legal come back on accusing a single company (that is of course if there is a single company which is responsible for the problems I must say), I guess those people with more legal knowledge will have somehow got their money back already.

What somebody needs to do, is explain the legal process (if there is one) which is needed to be taken in order to force the check backs to be given.

As you may have guessed I’m not in the position to do this because of my limited legal knowledge, however I would be willing to help in any way possible.

    Best regards
    Paul

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

First things first. Perhaps someone would like to try and interest the BBC or any major media outlet to find out why the networks allegedly decided to bring CASHBACK, from a plethora of small and relatively small companies many with modest ABOUT US details, into being. My view is what should have happened from day one is that AGENTS should have been paid commission BUT the deal should have been direct with a network operator.
Please remember CASHBACK is brought to you by those wonderful people (the networks) who insist that every mobile contract can only be sold with a mobile phone. So let me see: is that good for the networks? Is that good news for the mobile manufacturers? Er... that's it... No I think I've missed a grouping... It's on the tip of my tongue "necessary evil..." Oh yes. Is that good news good for customers?

Now it's possible that in the regulations at the start it said the networks were not allowed to sell all contracts themselves. If that is the case it would be my guess that CASHBACK was designed by them and pushed through a regulator that may not have appreciated the ramifications of CASHBACK.

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    Hi Everyone,

Well seems everyone has faced a problem with cashback. If you look at the strategy firmed by the operators like Car phone warehouse and others there is a catch. First of all they send you documents and they want us to send the document back to them with all the bills - ok that is acceptable for them to check we did not change the tariff. but then the time limit again it is catchy.

I have been denied cashback from 3 companies which is quite astonishing i mean i am no more surprised i actually have to laugh at the scenario of how the operators work out to make sure we are not paid and they get a bit higher profit.

I have recently tried www.chatterbox.com well lucky i got my cashback back on time :) quite happy for that even with three.

    Cheers

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    Hi Paul,

I have the same story as you and not for one but 2 mobile phones from carphone warehouse.

When I sent my cashback claim for 4th bill (Contract from Orange) in June 2006, I was informed from Carphone warehouse that they had problems in printing cheques and therefore I need to wait for 21 days more. After 21 days, when I tried again, I was advised my cheque has been cancelled and reissued which will take 60 to 80 days!!!!! I again rang after 80 days (by this time I already sent my 8th bill for cashback claim) and they could not find any valid reason for Cheque being not received. All they can do is again cancell the previous one and reissue for which I was advised to wait another 60 to 80 days again!!

So far, I have received nothing but excuses from Carphone warehouse for my 3 x cashback claims ( 2 for Orange phone and 1 for O2 phone) and altogether I've ended up in loosing more than £200 so far. Still I've to claim my 12th bill for Orange phone and 8th and 12th bill for O2 phone which I am not gonna get refunded anyway! (another loss of approx. £200!).

Although I must say that I received a text message from E2SAVE (group company of Carphone warhouse) today saying my Orange phone contract is soon due for upgrade!!!!

Please keep me updated if you get any reasonable feedback from this company as they're making millions in turnover and this is not the case with mobile phone customers only, you'll find the similar stories from Broadband customers as well.

I can be reached at darshakv79 AT yahoo.com.

    cheers!

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    Hi my name is Paul

Same thing has happened to me, the Carphone Warehouse first told me that they had trouble printing a batch of checks (and my check was in the batch) so it would be 1 month late,

I waited and nothing happened, I rang them and they kept promising me that I would have it, they kept saying it is going to bit 2 weeks, etc. I eventually told them that they were not being truthful,

I then said that I demand the payment on to my card, (they said it would take 21 days), but again the waiting game, I still haven’t got it, and iv been trying since June 06, I have started going into the store to complain, its easier that trying to ring even though it not easy to get there because I’m disabled.

I’m going up there today to complain; it’s at the rebook, if anyone wants a peaceful protest?

My email is p.m.cartwright AT googlemail.com if anyone wants to contact me for resons about this subject.

    Bye for now

    From Paul

Re: mobile "cashback" contracts. BBC Breakfast TV wants to hear from you

    Hi Duncs,
Thank you for replying to my e-mail, I am really worried that Carphone Warehouse look like they to have been ripping people off on this cashback contract like the other companies, I hope I am wrong, can the experts on this site look into this situation for Duncs and Christy please, or can they ask Carphone Warehouse to honour there contract, because I will be seeking Legal Advice, if they run away from there responsibilities to there customers. Christy.
