     Just to add my voice

    I did a little chasing of my own by finding out the phone no of the 18 Market Place in Bingham Notts (specified in the contract "Complaint" section!!! address.  Surprise surprise not listed.  However, I spoke to the people who rent the office downstairs (18b).  They confirmed that the company had gone into administration.

     interestingly, I also found out from them the landlord, a Mr Kevin Farrell annoyingly - disconnected no.  I've not chased further.  I wonder whether he can help or is involved!

     I got my very first installment but again haven't had anything for a few months.  Now I know why!

    I'm not holding my breath but will follow up with Vodafone and lodge my name with the administrator.

    Best of luck and I can quite happy to be involved if there is a class action going on.

    Agree with your sentiments re:class action, however I can only provide actual advice here rather than active support for this.....I can however maintain profile within the media, there was a piece in the Sunday Mirror and The Times driven by our statements

    Good luck and keep fighting, change will happen but it may take time

    Hi all

    Personally I have written off the chance of getting any money back, then if I do manage to recover anything it will be a bonus.  For the sake of £420 obviously the cost of legal action is just way too prohibitive, and I'm not convinced about a class action succeeding in this case.  It seems as though we may be in for an easier ride in the future when it comes to class action lawsuits, but at the moment I'm not sure how easy it is to get something like that off the ground.  Plus the claimants have to be prepared to share the costs if they lose, as I understand it (but I am definitely no expert).   There is an interesting article online in the Telegraph today about class actions in the UK - http://www.telegraph.co.uk/news/main.jhtml?xml=/news/2007/11/26/ncomp126.xml  Not sure whether the proposed changes would affect the sort of scams Mobile Media have been running, but it is interesting the government are looking at this in any case (although I would hate to see the UK go down the same road as the US with their 'sue everyone' culture!)

    It is the principle of this scam that particularly annoys me, as Mobile Media have based their whole strategy around the fact that not enough people would be able to meet the terms and conditions of the cashback agreements.  Clearly this was pretty stupid and irresponsible of them.  Even if the chances of recovering any money are very low, I would like to see some group pressure somehow put on the network providers and the government to wind up these cashback schemes where you have to claim the money back in installments afterwards and the network providers have no liability for the deals if the retailer doesn't meet its obligations.

    I really wouldn't know where to start in terms of getting a group together to lobby the government and network providers though.  It would require a large number of claimants to get together I would have thought to be able to generate any kind of momentum or publicity.

    Thanks for you reply, I spoke to Orange people they said they are no way related to cashback claims, they can't put me into lower tarrif what I want but they can only put just 5£ lee than where i am know in a month and so on.But pls anybody want to take any action about getting money from Mobile media pls let me know.

    one person is not strong enough for them.

    also they will surely not entertain anything like a cashback at this stage. it is standard industry practise to not give anything away till there is no other option. they know a person trying to save on a mobile bill will surely not be in a position to take them to the cleaners. this is where the class action comes in.

    i am sorry if i have to disagree with rob here, rob's is a reactive proposition, we need to be proactive.

    we need critical mass and some of those human rights champion lawyers.

    Glad you have been offered a better deal - it is very unlikely that anybody owed cashbacks by CNM will get any money back from the whole debacle......personally I think all you can do is log your complaint and leave it with the administrator...then keep your fingers crossed!

    it will be a costly and time consuming process, but justice will prevail in the end.

    i hope some good lawyers/law firms offer their services. this is the time for free winnable publicity.

    Hi all

    Unfortunately I am in the same boat... have around £420 outstanding from Cool New Mobile, or would have by next March when the contract is due to end.  I haven't contacted Vodafone yet, but judging by their statement above I can't see them being very helpful.  At least I now know why I hadn't received my first cashback cheque despite an email from CNM assuring me it was being issued on 22nd October.

    I have often wondered about the business model these companies work on, and clearly there was a reason why!  I had some problems with PBD customer service once before so I guess I should have learned my lesson last time around.  I would think the chances of any of us recovering the money individually has to be pretty low.  The only chance of any action has to be if a large number of people can get together to pursue this, and lobby the network providers and the government to put an end to these rogue cashback companies' scams and take some responsibility for it.  It seems to have worked to some extent with bank charges.

     Will keep my eye on this post to see what progress is made, if any, and what views people have on this situation.

    I had a 12 month contract with o2 which I took through Cool New Mobile. I got my first 3 cashback but not the last two which I have been waiting for over 3-4 months. CNM confirmed that my cashback papers were in order and I should receive my cheques shortly. The 2 claims would total gbp 168! Is there any way or chances of getting this back legally?

    you have a good point. and i think collectively all should demand monies back from the parties to the contract.

    afterall phonebox and their cronies et all are authorised by the air time providers as agents to sell the air time contracts.

    and as they say how can you sell half an orange, it is either full or none.

    i personally feel these air time companies are/were in connivance with these operators. they should be made to pay back.

    I had reduced my deal with voda last wk when I heard abt CNM going into administration. Wld we be able to claim our cashback from Voda??
