    missold 3 contract by 3rd party company

    my 18mth contract with t-mobile ends next month, yesterday i got a phone call from what i thought was t-mobile offering me an upgrade. the woman i spoke to on the phone was actually from a company called free upgrades (which i didnt find out till later on), she offered me what sounded like a good deal with a new phone and also said that t-mobile and 3 were joining somehow and goin to be digital? and this would mean better signal coverage. i thought she was offering me a t-mobile contract but after i agreed i realised i had actually agreed to joining 3 on an 18mth contract. she told me i would receieve a copy of the conversation for myself, i was then transferred to someone else to confirm. today i received the phone and the contract and the recording i was sent was only of the part of the conversation i had with the second person where the contract was confirmed and not the first part of the conversation where i was mislead. also the phone i was sent, i believe is a reconditioned one as the battery is a mess on the outside and also it didnt come in a nokia box as i know all new ones do. im really annoyed and believe i was missold it. is there any way i can get out of the contract?

    you have a certain cooling off period with any new contract. look at your t'c and c's - its normally 14 days so send it back and tell then you want to cancel

    i have checked the t and c's and i have 7 days to cancel. by cancelling would i have to pay the full amount of the contract and cancellation fees as i have not used the phone or number? when would the contract begin? would it be from when i took the call or from when they take over my account from t-mobile?
