    lose only the deposit or more than that?

    Hi

    Ordered a new car last week (band new model on sale - signed the order & paid 1000 deposit). In conversatiom with the dealership yesterday, I got to the conclusion that some things I though were included in the deal, actually are not and the order actually doesn't specify anything. Nevermind the fact I think I was treated unfairly, I m now in the process of cancelling my order. I do expect to lose the deposit but my question is, can they charge me more than that? I really lost all my trust in them and I won't to make sure that they don t have a leg to stand on. Thanks

    RJS - Was the car purchase dependant on you taking out a finance agreement through the dealership or was it to be a cash deal ....or financed through an outside credit source.?

    it is a cash deal with part exchange. No finance. Thanks for your help

    Hi - They cannot charge you anymore than already deposited... unless they could prove that they have incurred extra costs i.e. by fitting added special exras to the car that you had specifically ordered or preparing your P/X for resale etc..

    If it's mentioned on the paperwork that the deposit was refundable then they have to give you the whole £1k back, if there is no mention of this, then they are only allowed to keep reasonable "out of pocket" expenses they could demonstrate they have incurred from the deposit you paid, with the balance being returned to you.

    Hi. Thanks very much that is really helpful and puts my mind at ease.

    One more question if you dont mind. The biggest issue with the dispute I m having with them is related with the warranty. The phone negotiation started based on the price that included a 4 year warranty. At any stage in the negotiation they ve mentioned that, for me to get the car with the price i wanted, the warranty would drop for 4 to 3 years and on the order that I ve signed ,the warranty bit was left blanked by them. Now they re now saying that, if the warranty bit was left blanked it is a standard 3 year warranty, not 4.

    I do feel that I m a bit responsible for not making them to write everything that was included in the deal - still I think it was their responsability to fill everything in the order to make it clear to everyone. Do you think I m right on this?

    Unfortunately until it's agreed and put in writing to make it legally binding, then any agreement over the warranty will be regarded as you having only the standard amount of warranty that the manufacturer offers. Whether that is three or four years depends on the car manufacturers policy....any extra warranty will only be at the dealers discretion to make the deal attractive to you.

    i come onto this forum and check for advice but i always seem to come across the name "commankiller" , i sit here and think this guy must live on this website as he is always on ere talking away and over blowing peoples queries out of proportion that it just makes the whole thing confusing, please can you find yourself a job or find another website to live on!

    I think you'll actually find the name is "conmankiller" and is a very respected and knowledgeable advisor here.

    I don't recall you helping anyone yourself, so what's your beef? Feel free yourself to "find another website" if you don't like it here!

    hash - I am treating your comments with the contempt they deserve. I would not wish to be responsible for confusing your overworked mind anymore than you already admit. There is only so much common sense or intelligence that some individuals craniums have the capacity to hold, yours appears to have exceeded it's paltry limits.

    advisor ? so why dont you make a career out of it? havent you got anything better to do? i mean even if it was a career it must be a very suicidal job always on the net advising strangers for free about random problems lol

    Hmmm well I'm not in debt have a wad or ten in the bank, owned my own private house outright mortgage free since early thirties along with other properties, retired at the age of 45 years am still well alive, suicide not a problem... that comes naturally with old age.

    I got so fed up with making all that money out of it by charging people extortionate fees in the very early stages, that I guess a twinge of conscience kicked in & made me feel... I just have to do it all for free now .!

    What's your take, are you able to contribute anything useful.?

    conmankiller: I didn't want to reply to hash post (after all, it was done on a thread that I ve started...) - I felt you were more than capable to do it by yourself, as you proved in the end. From my part, coming here for the 1st time last weekend and getting the answers and support you gave me was absolutely brill and did put my mind at ease. If anything, we need more people like you around.

    im only messing about, dont take it to heart , i appreciate that you are willing to spend your spare time helping others and sharing your knowledge , in fact you do have a lot of knowledge , can i ask what you do?
