    Account no:

    You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

    I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

    I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

    I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    i have not actually sent them a letter i phoned them about a yr ago when i first recieved the letter and asked them to send me proof of the debt and they just sent me one of there letters saying i owed them money.

    this is the first time i have heard of them since.

    if i do have to write them a letter what can you suggest i write in it thanks

    If you have sent the 'prove it' letter then it is up to them to give you the detail. See what comes back. My guess is they know its coming up to be statute barred and are having one last go before writing it off. Relax!!!

    i recieved a letter about a year ago claiming i owed this company money from a t mobile account that has been cancelled for about five yrs. i phoned them up and asked them to send me proof of the debt and they just sent me a letter of theres with the debt on it nothing with t mobile on.

    i ignored it as i figured t mobile would not have let me cancell my contract if i had an outstanding debt.

    i have now recieved a letter asking me to buy back my account for more than what the debt is or pay monthly payments for more than what the debt is.

    i am really worried about this as the letters are going to my parents house where i lived at the time of my t mobile contract and it is going to effect there credit rating.

    Send it recorded sign for first class and keep the receipt so you can prove that they received it.

    Not really a legal issue its just that it has been known (allegedly) for some debt collection agencies to scan your signature and then create a new credit agreement when they didn't have one in the first place. Just never sign anything sent to them!!!

    Can I ask why you have put "do not sign" Is there a legal issue here.

    How brazen can these people get?

    They're trying to get you to pay them money by using some new language to cloak a very old fashioned style of debt collecting.

    They claim you owe T-Mobile some moeny. Get them to prove it. A copy contract for instance, and a statement.

    They don't want to do that. Their business is built on buying debts for very little, and making a profit by collecting anything at all. So make sure they prove the debt to you before you do anything at all...

    Hi Everyone

    Can someone help me at all with a letter i have receved from Lowell portfolio.

    The letter reads

    "Our ref********

    Original creditor: T-Mobile (UK) Limited

    Balance outstanding: £26.71

    I am writing to you to offer you a unique solution to the outstanding debt you have with our client Lowell portfolio I LTD by giving you the opportunity to bid and buy back your account.

    The concept is easy to follow, you simply bid for your account and if your bid amount reaches our reserve price then the account is yours, you will then no longer receive debt collection letters or calls, any pending legal action will be stopped and your credit file will be amended accordingly.

    Alternatively if you are unable to bid a lump sum to buy your account back i am willing to reduce your outstanding balance by 25% and you can pay the remainder at £35 per month"

    I did have a contract with T-Mobile about 5 years ago, i never got in to difficulty paying them back and i canceled my contract by letter and never heard anything from them untill i had this letter turn up on my door step saying i owe money.

    Iv read a few postes on this website but could not find anything that talks about Buy back your account, just wanted to see if anyone has any info regarding this and any feedback on what i do next.
