    Land of Leather - Faulty Goods

    I purchased a suite from Land of Leather in Wakefield last year, 2 weeks ago I noticed patches of orange were appearing on my brown leather suite. I contacted Land of Leather who sent an assessor who said the suite was a "write off" due to a manufacturing fault in the dying of the leather, he said he would send his report to Land of Leather and we would hear from them asap. I have had numerous phone calls with the land of leather over the last fortnight when they were to contact me and never bothered. Today (Tuesday 25th September 2007) I received a message on my answer machine from the manager of Land of Leather Wakefield saying he had spoken to the area manager and as the suite is no longer sold we could ‘reselect’. However, we will have to pay a ‘usage charge’ of £137 due to the ‘length of time we have had the suit’. Given we paid £899 for the suite less than a year ago this seems extremely excessive. Please could you advise me on if we have to pay a ‘usage charge’ before we can get a replacement as this does not sound right to me.

    I am taking a refund for my faulty goods and they are taking £148 usage charge of that, they are within their rights to do this.  If they are taking money off you even though you are reselecting a suite from them I would ask for your money back and go else where.  It doesn't sound right to me, but it is legal.

    We have just had our suit delivered (20/11/07) and on arrival it had a tear on one side and scuff marks on the other side, my hubby told this to the delivery drivers who did document this and said someone would be in touch within 48 hours.  Just wondering if anyone knew how we stand with this?

    You have the right to reject the goods as unfit and damaged under the sale of goods act, you can ask for a refund in full, or accept that they deliver a new replacement suite re-delivered free of charge.

    If you accept the replacement get them to put it in writing when they will re-deliver, if that meets with your approval, if not demand a full refund.

    If they do not deliver in the time as stated in the written confirmation i.e. 7 days or the time you have allowed, then you have the right to the return of your money in full, because they have broken the written agreement.

    Thanks killer just wanting to get a bit clued up so i know what i'm talking about in future communication with land of leather.  Not getting off to a good start though, because the drivers did'nt even pass on any information.  Get the feeling i'm in for a bit of a battle.

    sammilou --- You have no problems here as the suite was only just delivered and the damage was present on delivery possibly witnessed by family, the fact the driver did not pass the information on is not your fault at all.

    Simply tell them you want to reject it under, "the sale of goods act" as unfit for it's purpose and demand as above, either a full refund or at your choice a replacement delivered as per the timescale that they will put in writing.

    Those are your legal rights, if they refuse they are breaking the law.

    PS -- Do not let them fob you off, or accept any offer to repair. This could lead to long delays with the damage never actually getting repaired, demand a refund or a replacement subject to your agreed re-delivery period put in writing only.

    Thanks again killer, i won't be getting fobbed off just wanted to get all clued up, will only argue my point when i'm in the right and will admit when i'm in the wrong but know now that i'm in the right, so land of leather here i come lol.

    HI ALL !!!

    i purchased a 3+2 seater and it was delivered damaged. long story short. 28 days later.. manager said he will replace bot sets. another week on and chasing him like a hound dog, i get my replacement. IT was not NEW. it was from the showroom. The back of the safa all worn, the seams all about to rip in certain places. the electric recliner buttons are broken, there are major scuff marks on the foot part.

    i drove to the store to demand a refund, to my shock the delivery guys were installing my set in where the display set came from. i walked over and i looked at them to see my dog hair in the gaps of the sofa.

    THE MANAGER is never around. the deputy manager does not exist. no staff have a clue. DONT BUY ANYTHING FROM LOL.. not worth it. i have read so many blogs on bad service. no something u want to read for a big company.

    go to another store in JOHN LEWIS. pay more money an get peace of mind.
