Yes we too had the letter from Land of Leather on 19th February 2009 offering delivery in 10-12 weeks together with the free delivery or 5% discount.
Having just sent the time is of the essence letter to all concerned parties on Friday 19th February I phoned Consumer Direct to make sure that we would not be shooting ourselves in the foot if we responsed to LOL.
I was advised that if we were happy to accept the furniture under the revised terms to send an accompanying letter again stating time is of the essence and stating the very latest date on which delivery would be accepted, which for us would go from 7th May 2009 (This was the end of the 14-18 weeks quoted when we ordered on Jan 1st 2009) to 11th May 2009 (the 12 weeks from 16th February date of LOL letter), and if the furniture was not delivered then the contract would be terminated and we would take our business elsewhere.
To be honest we were considering agreeing to their terms as it was only four days outside of the original timescale but after reading the later posts we are thinking why should the administrators call the tune and expect us to dance...afterall so far their information has been inconsistent and the update via the LOL website now non-existent so is this just delaying everything yet again. Afterall if this letter was coming out why could no-one tell me this when I spoke to the Hotline on Tuesday nor when I spoke to the store the same day????
We have just sent our second e-mail to BBC Watchdog hoping that they will take up the challenge and advise us..with the request from LOL to answer their newest letter in 7 days ...they cannot answer a letter in 14 days how does anyone know what to believe!!! Therefore we are going to go with the post from Lawro and cross through the form stating that if they are unable to meet the deadline of 7th May 2009 they can go whistle!!! We are not going to forego our original rights and having already sent a time is of the essence letter have stated our intention.
Also just thought if everyone is getting the same letter with a timescale of 10-12 weeks, does this make the whole thing less credible as surely all orders would have been at a different stage e.g. some made ready to go..some not yet maufactured... and hey presto everything is on the same conveyor belt!!!
There is info on the Conditions of Sale form Section 11: stating that if LOL order may not be cancelled unless LOL are in breach of their obligations to you. there is also the clause on the Credit agreement Section 3 that if the contract is not fulfilled , perhaps because the supplier has gone out of business, you may be able to sue the creditor. I believe that with a credit agreement the finance company is equllay liable for the supplier's breach of contract providing the purchase was over £100 and under £30,000. This means you may claim against the supplier, credit company or both jointly...this would be in the case of a deposit having been paid obviously. Look on the Citizens Advice Bureau website....I now have so much info printed it is mad!! or is that me????
