ok what happened to start with:
Othe way home from work on 9/4/08 a taxi in the left hand lane on a 3 lane roundabout(See Diagram) cut me up resulting in him cliping my passenger side front wheel arch
so we pull up at the side to exchange details the barsteward points the finder at me saying i wasn't indicating!!! :O
so correct me if im wrong, was i wrong to not indicate?
no, i dont have to indicate to go straight ahead, he was in the wrong being in the left hand lane to go right?

so in this diagram you see me(NA54ZPK) behind my work friend and the taxi to our left, the left hand lane is for straight ahead only, middle for straight ahead and right, and the right lane is for right only.
Note: this roundabout is sectioned with traffic lights.
As Dark Blue pulled away to go straight ahead i started to pull away but Taxi pulled away quicker tried to go through the gap but hit me, i had no where to go, had a car to my left and right and up my rear.
so now 4 months on, the case is still not resolved, my insurers have contacted his insurers and are waiting for him to submit a statement, but he has no damage to his car, so all the time he doesnt submit a report, my insurance companies can do jack ****, untill they are out of pocket, i have not had the damage repaired as 1) its still roadworthy, 2) i dont have the £400 to pay my excess untill the case is sorted.
So bassicaly where do i stand, if i pay the £400 excess i run the risk of being £400 out of pocket if a court case fall through, and i will be down 3-4 years no claims?
But if i don't pa the £400 im still going to be just as worse of as i will still need to pay to get the car repaired?
Surely he has to have a legal requirement to file a report about the incident, at the moment i feel cheated and completely had by this guy, as he can keep on ignoring the requests from insurers for a report and face no excess charges or no claims loss?
