I'm just looking for a little advice really, in 2008 I opened a Student account with the HSBC, this came with a £500 overdraft. I used my £500 over draft and over a period of time nothing was going into my account (typical student) as nothing was going into my account I began to receive close to 10 phone calls a day (no exaggeration) from the HSBC questionning when I was going to repay my over draft.
I said I was told I had to pay it back once I had graduated which they did not accept, sometimes they would call me and just let it ring once (Probably to show on their system they've called me) eventually the harrassment became that ridiculous I wrote a letter stating if they continued to call me in the manner they have been I would sue them for harrassment. They were so rude and nasty on the phone.
This seemed to work as all phone calls completely stopped! However looking at my credit report, the 3 months in which they were constantly contacting me they've put late payments on my credit file, just 3, obviously with the 1st month saying 1, 2nd month - 2 and so on.
But, when the month I sent my letter of complaint when the calls stopped, there are no marks on my credit report and its just showing as normal again (apart from the 3 late markers) and has shown as normal ever since July 2009, despite nothing else going into my account and not repaying the over draft either. So the over draft is still outstanding. I still get my statements every 3 months or so but they never contact me about it.
I want to repay it now as I've graduated so I'm due to pay this over draft off, but before I go in and pay it off - are they within their rights to have put them markers on my credit report despite me having a student over draft which states I did not have to pay it back until I graduated? Do you think I can appeal it? It just doesn't make sense to have the markers there but when I wrote a letter of complaint they stopped causing a fuss and put my credit report back to normal (apart from the mentioned 3 late markers) despite me not paying a thing?
