Re: How to find a will and Life insurance policy

Ask a Solicitor to write on your behalf to the HM probate office for a copy of the will they are a matter of public record and easily obtainable, but the full accounts showing all the executry calculations are only availabe as an entitlement to the named beneficiaries within the will.

The will has to state who the executor was or if it was another firm of Solicitors, from that information your Solicitor can demand a full accounting on your behalf that will show the size of the estate with all the liabilities deducted.....then it will be more obvious whether you have had your correct share, if not, then consider starting legal recovery action to reclaim what should have been rightfully yours.

    Thanks for the info.

Only problem is i havent had any contact with my step-sister for around 7 years and have no idea who the Solicitors or executors were. I did not want to contact my step-sister.

I was hoping i could find someone who i could give my late fathers details too and they could find out for me.

    Cheers.

Write directly to the Solicitors or executors who have handled the will explaining who you are and your concerns, all beneficiaries named in a will are legally entitled to see the full accounting which includes computations of the in-gatherings..... compared to the outgoing liabilities and showing all the expenses / taxes incurred and crucially... how the net amount has been divided and to whom.

Sounds to me like your subsidising their lifestyle. ?

How to find a will and Life insurance policy

    Hi All

Situations many years ago my real father died, I hadn’t had any contact with him, since I had been brought up by another.

Saying that I did go to the funeral, where I did meet my step sister who was a biker / punk type person and brother who is mentally disabled and she is his carer.

At the time she informed me that he had left a will and everything was to be split 3 ways. They also informed me that he had an insurance policy and that we would all be receiving around £40,000 each.

A few week later my step sister contacted me crying saying that whilst she was dealing with the insurance company, she had told them that our father had been made bankrupt, and she informed me that they were not now willing to give us the money since it would be used to pay of his debts.

A few days later she called me again to say the insurance company would only give us £1,000 each and she hoped I didn’t mind that she had had her boyfriend forge my signature on some paperwork.

Me being the honest type person I am, didn’t think anything of it, but my mother was suspect.

After a month had gone by my mother phoned me to ask if I had received any money which I hadn’t, so since she did know my step sister and also her mother and didn’t live that far away went to see them. She asked my step-sisters mother if they had received any money from the solicitor who was supposedly dealing with my fathers estate, they answered that they hadn’t heard anything and that it was a sham that the three children would not now get this big pay out.

My mother asked for all the details so she could chase the solicitor to find out what was going on. My step-sister and her mother said they didn’t have any paperwork, and then quickly my step-sisters mother said that the children should get this £1.000 soon and on the spot wrote a cheque out to me for £1,000 and gave it to my mother to give to me.

Many years later now I heard that just after the death of my father my step-sister who at the time was being chucked out of her house for not paying the mortgage had bought a bungalow and had an extension built, new kitchen etc.

So my question is how would I find out what the will said and how would I find out about this insurance policy and did the insurance policy really never pay out.
