Hi could anyone advise me how (if i can) i get out of this with carcraft..

My nephew (21) went with his mother (shes no stranger to debt) to carcraft and signed some sort of aggreement and had a £200 deposit taken from his bank he's a good lad fights like a mad man but not too smart the end result is he is settling down has a baby on the way and once i explained that its not just the quoted £44 a month but insurance (just passed and 21) and then petrol he realised he'd made a mistake and just wants out will he get a deposit back? finance hasnt even been aggreed yet apparentley they were getting back to him today to see if he can have it or not so on this what are his rights? It seems that them checking his credit means they wont have prepared the car so cant say its valette cost but you know what this company is like anything for the sale and if they dont get the sale they will get what they can out of you.any help greatly appreciated!

Hi -- Sounds like he's signed an order form and left his deposit to enter into an agreement with Carcraft and a so far unnamed finance company.

Because this agreement is a Three party agreement (Him, CC and FC), any one of the parties can withdraw from the agreement before the agreement is executed. He can inform them in writing after making a telephone call to inform them. He must stand firm and not let these bullies keep his deposit.

The deposit is refundable despite what they will tell him. There is only resonable costs for the car being off sale / prepped for delivery that they are allowed to keep.

The sales manager in there will be very abrupt, probably rude and without doubt arrogant. This is because he knows the law and wants to frighten you into thinking you're wrong.

    Go get 'em.
