    Going into business with family

    My partner and I are in the process of setting up a new company and have decided of a 50/50 split. I have put in £5000 and he will do the same in the near future.

    We have discussed writing a contract between us to ensure the in the event of our relationship coming to an end, neither will loose out. I want to make sure that i cover everything so that if it does turn sour, i'm not left out in the cold, being forced to sell my shares etc. Any help with what i should cover in the contract would be really appreciated.

    You need to see a solicitor. The fact that you are going into business with someone you are emotionally linked to should not be a factor. This is business - keep it legally ringfenced to protect yourselves if it fails.

    Try a test for me.

    Imagine the conversation wher e you and your partner have to discuss how you value your different inputs into the company. You're both putting £5K in cash in. Will you both be putting the same amount of work in? And the same type of work? If not, how will you decided between you how that work is valued?

    Then ask yourself if you want a solicitor to draw up an agreement to cover what happens if you disagree, or split.
