Hello All,
Ever since i took out a phone contract with Orange from the Carphone Warehouse in January the Nokia N95 that was supplied to us worked fine for the first 2 months or so but ever since then the phone has been very buggy & tempermental. I know for sure this is a software fault and as Nokia recommended i have updated the phone's software firmware version to the latest one but this still has not fixed the problem what so ever. I decided to contact Orange the other day as i finally got fed up with it as the phone has gradually got worse but the guy could not help me out because the N95 i had was regarded as a "generic handset" and he explained saying that because the phone was supplied from the Carphone Warehouse it did not have any of the Orange software built into the phone's firmware at all and this did explain why the N95 i had did not have any Orange logo printed on the phone anywhere.
So then the guy at Orange suggested that i take the phone into the Carphone Warehouse store. I took the phone there today and i was hoping that they would replace the phone with a different N95 but all he suggested was that the phone could only be repaired and if i did not have any phone insurance it would cost £50 up front to have a courtisy phone which i would need while he N95 was in for repair, i told them that i had phone insurance supplied from my bank but the guy at the store did not want to know and came out with a load of rubbish saying "oohh no we can only accept insurance that has been taken out from us because the insurance from different companies costs too much in excess!" what??? its not a car!!!! I got really angry at this point and left the store.
I pay for a service to use and i pay each month on time and never missed a payment surely they should supply me with a FULLY functional phone and top notch service but clearly in this situation they have failed to do it for me. I am now fed up with all this and i wish to cancel the contract. I have read up on a few horror storie about this with Orange and that if you cancel before the contract ends they want you to keep paying the remaining month's worth of the contract??? No way are they getting any of my earned money for a service that i will not be using?? Thats robbery. I cannot be using a service thats crap. I feel that i am really stuck here and i just wish they could of replaced the phone or repaired the phone easily but in this case it isnt really that easy. If i call them up and attempt to cancel and if anything like then asking me to keep paying me for the rest of my 9 months for the contract that i will not be using then i will without a doubt be complaining to Ofcom because this is ridiculous. I am aware that i will have to pay a month in advance for the cancellation which i am fine with and also i will be expected to send the phone back to them if i am correct? Surely they cannot complain about that if they get the phone back but i will not keep paying them money each month after.
I hope someone can really help me out, Thanks - Liam
