    write to them and state theres nothing in the t&c and unless they can prove otherwise then the agreement is terminated and unless,if they wish to take this matter further then please confirm by letter of theyre acceptance of your 30 days notice.. should no confirmation be recieved by two weeks of the date of your letter tell them clearly that you will be forced to report them to ofcom and the office of fair trade with a view to legal action its best that you insist that all cmmunications should be by letter and you wont accept any calls by phone and send the warning to them by recorded mail and keep a copy of your letter and anything theyve sent to you safely stored away

    in the event they try involving debt collecters which theyre famouse for search the forums here for lowell portfolio for basic info on how to deal with those situations hope this will help you and be safe in the knowledge that the contract is no longer valid and they cant hold you to those terms and conditions no matter what they claim.

    I did give 30 days notice, but because they gave me the PAC code which I didn't use, my 30 days notice and definite "cancel my contract" was not valid apparently. And in the Terms and Conditions there is nothing ab the clause that if you don't use the Pac code there will be no cancellation...I feel cheated and ripped off..

    That is true. TBH, that is in *most* users interest as it guarantees continuity of their number. I assume for some reason you didn't want to retain your number???

    You ask what to do now. I suggest you read Paragraph 10(c) of the 3 Mobile Terms and Conditions and give your 30 days notice of cancellation again. Once you are shot of 3 Mobile after 30 days you are still entitled to pursure any grievance you have which you think the recording may have a bearing on, but given that you will only be talking about a further 30 days of paid service I suggest you put the PAC lesson down to experience and move on to a better signal.

    I am having the EXACT same problem with them NOW!!! The guy tried to convince me to stay with Three saying they are "working on the signal in the area" and to give them another month, i said No. Then he failed to tell me that not using the PAC code means the contract will carry on!
    What do I do now?? I have asked for them to find the recording of that conversation and they said they will get back to me in 24 hours..they haven't..

    Hi,

    First of all I have to say the passing round for 1/2 hour while you're trying to cancel is shocking. However, I must point out a few things:

    1. It is not the PAC code that has kept you on the 3 network. All the PAC code does is allow another provider to port your number across to their network. Your new provider uses this to inform your old provider that they wish to tx the number across, that is all a PAC code is used for.

    2. If you explicitly stated that you wished to cancel, which I'm assuming you did as you managed to get a PAC code off of them, then they have no right to keep billing you. As long as you are outside your minimum contract term then they have no right to keep billing you as long as you have given them 30 days notice. However, you would still be charged for the 30 days notice, they are still providing you service during this period. As per your contract.

    Make a complaint, if they get stroppy with you then submit a Subject Access Request to obtain a copy of the telephone call. This will cost £10, but then they have no argument if you can be heard stating you wished to cancel your contract.

    no signal in my 3 phone for over 6 months decided to cancel my house is in a hole, i used to get a signal with three, thats untill they changed from an 02 carrier mast to orange mast, and orange there is no signal in my area, took over 1 week trying to get to speak to them, eventually got indian call centre who for 45 minuts kept me on the phone going round and round asking me between my requests to cancel if i wanted a new phone or simcard, or to upgrade, after 30 mins i reallised i was bieng kep on the line and high pressure sales tactics were involved so i didnt leave, they simply would would not accept i can get no signal where i live and continued to try to sell me a phone, they then finally agrreed to close the account and asked me if i wanted a pac code, i said yes, they said it was only valid for 30 days and muse be used in 30 days, , BUT THEY NEVER SAID ACCEPTING A PAC CODE WOULD MEAN MY 45 MINUTE CANCELLATION PHONE CALL WOULD BE INVALID IF I DIDNT USE THE PAC CODE so 2 months later im still getting bills and phone them again, if i was was told a pac code would keep my acount active i would have said no, its my belief there using this to in a deceitful way yo get a few extra months payments, even thought my 18 month contract has ended, is it me or do others consider a 50 minute call to cancel a no longer working phone excessive, they wouldnt take no for an answer , recommending better phones, new sim card, they wouldnt stop. i came of the phone feeling threatened, blackmailed, and trapped, will never go with three again i now know why they use indian call centers rather than uk, ones,it not just because of the lower cost its simply too far to travel to bang on there door cause a scene,,,,,and complain,,,,,,,,,
