    Dismissed Insurance Claim (Where do i stand)

    Hi All,

    Roughly a year ago, I got hit by a public organisation vehicle, I had a third party insurance claim at the time, so I claimed from the third party’s insurance, a year on, and after going to court, I have unbelievably lost the case.

    So as it stands, they have collided with me, and my car is a little damaged, but no one to claim from, so I will have to repair by myself if I want the car repaired, my question is, I have 4 year No claims, and in the process of buying another car, I normally use price comparison websites to compare prices, but they all ask if one has ever been in an accident before, I don’t know what to state here, can anyone help. Would it be an accident because of my fault, even though no insurance company has paid out to me.

    Please I need urgent clarity.

    Hi -- Yes you need to declare all accidents whether your fault or not and irrespective if a claim was paid or not, otherwise any future claim could be denied because you have failed to disclose this in your proposal.

    However, you have the right to inform the new insurers that there was no financial loss or payment of any kind made by the insurance company through this accident. You can ask for their agreement that you are not to be financially penalised by any increased premium, or lose any no claims bonus through this incident, as they could be considered to be treating you unfairly.

    To obtain quotes of the correct price consideration get a price first online as if you have not had an accident, then before accepting ring the company first with the quotation number explaining the situation and tell them about the no loss accident, that way you will be sure the price has been unaffected when you disclose the information.

    Ask for their written confirmation that you have disclosed this information to them before agreeing to take the new policy out, that way there are no future misunderstandings should a claim arise.

    Hmm.

    Unfortunately if the case has been lost and the claim is to be settled in the other party's favour, then this is very much a fault claim which would mean an increase in premium and loss of some of the No Claims Bonus entitlement (unless protected at the time of the loss).

    The increase in premium would not be treating you unfairly as even non-fault claims result in an increased premium.

    If you had won the case at court, then this is an entirely different matter. Any disallowed NCB would be re-instated, and your premium would only rise in accordance with the risk as a non-fault rather than a fault.

    You should seek the advice from your current insurer to ask if the NCB have been allowed or disallowed.
