    all credit searches leave a footprint and in fact would be impossible to perform unless one was selected. a full credit search is possible without your permission by any company from whom you receive a financial statement that requires payment, such as utility companies, phone providers and so forth. however, because the search would either be to confirm identity or ascertain the next stage of debt recovery, it would not be recorded as a credit application search. to be fair, however it is recorded may make little odds if you are declined credit on the basis of extensive searches on your record.

    The question you asked them seems to have 2 parts. Can you hand the car back and can they re do the finance.

    In order to fully answer they would need to do a search.

    HOWEVER - They should NOT be performing any credit search that would leave a footprint on your history without first advising you REGARDLESS of whether they have covered tehmselves in some previous small print or not.

    Hi --- I will bet that somewhere in the initial credit agreement you signed, you will find wording to the effect, "that you also give your consent to us to make further credit reference checks", or similar wording to that effect, should you make any new application to them. ?

    I know it seems underhand and sneaky, but I will bet they have covered themselves in the small print. They could call your enquiry an application.

    Credit Search without my permission?

    Just under 2 years ago I bought a car through Creditplus. Excellent car, very helpful etc etc.

    Today I called Creditplus as i am interested in changing cars. I simpy wanted to know if they would take the car i have now back and supply me with another without the process of having to hand my car back and redo all the finance etc. It was a simple question.....or so i thought.

    Having just checked my credit file, i find they have performed a credit search on me. They never said they would do this, i never gave my permission for them to do this.

    Can they do this without my authorisation? Any answers gratefully accepted.
