    As Sparky has stated; the £1 token re-payments maybe the best advice and alternative you have based on the current knowledge that CCCS have about you, or CCCS knowing your situation like they already do with the information you have provided to them.

    If you read and absorb the comments made in the debt forum, it is very rare that a debt is actually written off....it is merely considered unenforceable, where a legally prescribed or executed valid agreement does not exist or cannot be produced to a court.

    The courts failing production of said document then have no power to legally enforce....although this still does not mean that the alleged debt becomes automatically written off as a result. The creditor can still always pursue and chase payment, subject to them not committing a harassment offence of course.

    My advice ..follow the CCCS recommendations. !

    It sounds like the £1 offer may be just this. CCCS should have told you what their recommended approach would achieve.

    As CMK has already said, you have been given advice by CCCS who you will have given much more detail to, and they are in the best position to provide advice.

    Stop listening to all the different things you are being told if it's causing you confusion, instead concentrate on doing what CCCS are advising you to do....otherwise you will be even more confused if you receive additional conflicting advice. !

    thanks for the info: recently i got a letter from another company saying that they wanted me to call them straight away or they would visit my address as they want to build my relationship with halifax..? the previous letter i got from halifax said that they had passed my account onto a collection agency called albion.. i contacted cccs and submitted my details as my partner hasnt worked for 18months due to a serious operation on her spine and thay said that i should offer them only £1... so many people are saying different things to me and i dont know what to do as our household is £1200 p/m down.

    Hi there,

    You need to do a few things.

    1) Speak to someone to get free debt advice:

    www.citizensadvice.org.uk

    www.nationaldebtline.co.uk

    www.cccs.co.uk

    www.payplan.com

    2) Write to each of your credit card issuers asking for a copy of your credit agreement under the Consumer Credit Agreement (CCA) 1974 s78.

    You will need to send them £1 for this. (as you have already done)

    If you have already received copies of the agreements create a thread for these and get some help reviewing them for enforceability. (Scan in images) If the agreements are April 2007 onwards they are enforceable.

    Not paying the regular payments will cause them to escalate their pursuit of you.

    You should tell them that the debt is in dispute until you have received a compliant Consumer Credit Agreement and that you will only deal with them in writing, as this is harrasment.

    Going down the route of the CCA to be declared unenforceable does not write off the debt, it just means that they cannot get it enforced by the court.

    As you have found out they can still pester the hell out of you, but stating that they can only contact you by letter should reduce this.

    You can also ask them to remove your phone number from their records.

    3) Search the forums for the posts already on how to deal with the various debt collection agencies (DCAs) and what tactics they use, and what their letters really mean. (lots of bluff and thunder).

    4) Share your experiences to get some advice and support

    can anybody help me, i have been reading your advise regarding credit cards and have sent off £1 and a letter to these people. 2 card companys say that they dont have to send me my original agreement, the rest of them have passed my information to debt collectors, they must ring me about 13 times aday saying that i owe them money and they want it back. what do i need to do as my hours have been reduced at work. i have explained this to them but they dont care... what do i do

    You need to get some free debt advice from your local citizens advice bureau, payplan, CCCS, or the national debtline.

    Credit cards

    please can you help, i have a few credit cards which i havnt been able to pay for the last 3 months, i have sent 2 x letters to the credit card companys asking for my original copy to which several have sent blank ones back or havnt even sent them. i sent a cheque for £1 as well. halifax have now instructed a collections agency to keep ringing me demanding i pay the full amount..what do i do next...
