    dont acknowlege the debt, there is a lot on this forum about debts over 6 years called statute barred. I searched for it and found a standard letter to send from a guy called connmankiller who seems to know a lot and is very helpfull.

    This is just one thread to llo at and see the letter template but dont call them and dont admit the debt ever just send the letter and postal order and see what happens - they probalbly bought the debt from the bank and are just chasing to see if they can get anything.

    hey there,

    Sounds like bad communication! if she is getting call from a debt agency, then the bank the debt was with will not be able to help. Once it gets to that stage she will have to deal with the company who own the debt. When a customer defaults on payments etc after a period of time the bank has the right to sell the debt to an agency. See banks t&c's for this. I would advise her not to avoid them as it will end up in court with more costs and possibly anything she owns be taken as collateral.

    Get in touch with citizens advice to help mediate the dialogue with the company as they tend to be heavy handed in these matter. Sort out a payment plan even if it is 1 pound a week, she will need to show willingness to pay back what is owed there is no easy way out.....

    Evil sister got into a mess with her money several years ago - one of those bank accounts that offered priority loans and credit cards and overdrafts and she ended up in a fair bit of debt. All the outstanding amounts were with the same bank. They cancelled her cards etc and I went into the bank with her to sort the mess out. They agreed a consolidation loan with only a really basic debit card and for the amount to be paid over x months. Now she did this and it is all settled. Also I was successful in getting her her charges back just before they froze claims (of her being £1000 overdrawn, she gor back £1700 in bank charges!).

    Anyway, suddenly she's getting phone calls and letters from a Debt Collecting Agency over the credit card element of the above account and debt - it dates back almost 7 years! She thought the credit card debt was included in the consolidation loan but it appears not. Now she's not spoken to these people chasing her, nor replied to the letters - what should she do? Can they actually chase something this old that isn't even on her credit file? They are threatening her with court when they've never chased this amount at all in the last 7 years.

    Would be grateful for advice.
