Ivo, I don't know your personal claim circumstances but if you have complied with the ridiculous proceedures and have the various proofs of posting, copies I doubt you will lose.Why would you? I think it is fair to say that courts are aware of the cashback phone companies. Problem will probably be enforcing the judgement. Check the moneyclaim website for details. These companies are slippery!! They know damn well that a lot of people will be nervous of going to law for numerous reasons. Even if people do go to Court resulting in them having to pay up they only have to pay an extra £30-£50 to settle, average £40. Say the average cashback is £400 pounds. If you accept the above then lets say they try it on with 1000 customers. If 500 claim they have to stump up additional £20,000 in court fees. However, the 500 that give up give them a nice fat £200,000. Net con proceeds £180,000. Nice!! Obviously random numbers here but even so. I would not mind betting that the directors of these companies have the 'give up on cashback' factor in their business plan. I have already issued a summons but probably won't get a response for a couple of weeks. The Moneysupermarket folks have said that they are going to contact mobile affiliates. Have a look at the 'phonebox thread' which can be found by clicking on the review section of the cool new mobile latest offer. Click on Mobile Phones above. Don't know the outcome. Hi Neill, yes i did, for the 2nd claim, i've got the proof of posting in date 14 july, so 6 days early than 1 months terms as was stated to send the claim form, the problem is that they've changed that terms from 1 months to 21 days...without give me notice...and when i've downloaded the form was already out of time, and signing it they said that i've agreed with the 21 days...what a bunch of twats!! i didn't even see the 21 days new terms!! That's my situation, my claim loss is £ 336, 2-3-4-5 cashback forms...Really disappointed becouse as you said it was deliberately planned...and i've also trouble with my car insurance due to my car has been stolen, after recovered, but the insurance is acting like them...still waiting to get my car fixed...so as you can see i'm not really in good mood... Ivo, Bad all round then Ivo. Still I would imagine you have least had the courtesy of a response from the insurance company. All we can with reference to mobile affiliates is try and keep the pressure on. Moneysupermarket have said they will contact them and people have issued summons against them. Even so people should ake sure they contact the appropriate authorites. I have contacted BBC Watchdog 3/4 weeks ago but no response. However I am now going to contact then and refer them to this forum. Keep the pressure up. Make sure you leave a 'customer review' of Cool New Mobile using the review facility of thsi site. Should be a few of them coming through today/tommorow. It take 48 hours for reviews to be approved. The one thing I don't want to happen is for people to be ignored. We should do our best to ensure that they either pay or face the consequences. They may go into liquidation but even at least through bad publicity we will be putting other people off dealing with them. Hopefully this forum will have already cost them money. I'm off to other price omparison sites today to see if they are advertising on them. Appropriate reviews will follow if I find any. Neill

Yes, the brands operated have been removed from the Best Buys tables - at present they remain within the full comparison. I will keep you all posted - and appreciate your comments in bringing this to my attention regards

Yes, both companies are currently listed with oursleves and I am aware that these are two separate brands operating within the same parent company. I will have further news to post regarding both companies listings by the end of the week As you can imagine, in our position, it is crucial that we only work with companies who have an excellent record in terms of both price and customer service. We do have a reputation to uphold and I appreciate all posts relating to this issue and thankyou for bringing this to our attention. After all, the whole point of operating customer forums such as this is to raise issues and understand the overall market - it would be pointless for us as an organisation to ignore the strong public opinion that has been raised here I cannot give any more details due to contractual obligations and potential legal implications regards

Hi Rob, Please can you keep this thread open so that people can inform those who wish to know what is happening with their legal claims against this company? The Phonebox direct thread was locked at some stage? I gave Mobile Affiliates (CNM) 30 days notice in late july to pay up before i commence legal recovery so it would be beneficial for me to know, providing they are still trading (i use the term loosely) by then. UNBELEIVABLE... I've JUST received a phonecall from a guy called David Aguilera from Cool New Mobile asking me if I'd rather have a NEW mobile phone handset INSTEAD of my cashback claims! The handsets offered are NOWHERE near the cost of the cashback claims I should be receiving; cheeky sods.
They really are desparate and this is a JOKE!

Further to previous posts from myself regarding this provider (s) - moneysupermarket.com have given notice on our exisitng contract and any products/services/links will be removed by close of business next Friday. In addition all Best Buy products have already been removed from our home pages. I appreciate all the comments raised by yourselves in bringing these issues to our attention - unless we receive complaints such as these we can never fully understand the nature of any business, despite undertaking rigorous checks of companies wishing to list their products within our site - prior to launch many thanks

BIG cashflow problem probably - once stock is offloaded, will it be the desks and the chairs they sit on? If so, i don't advise settling for the shredding machine - its done very high mileage (allegedly).

Rob, Good job! Am at present trying to find other sites/forums such as yours to spread the word. Oh well, I suppose actions taken here might save a few people from this company, whether it will do any of us any good is another matter. Personaly I will have news, if any, a week monday from court claim. Any objections to me mentioning your decision to BBC Watchdog? Can't imagine there would be. Regards, Neill
