    Just to let you folks know that I have issued County Court Summons against this mob. I will let you know outcome. Quite straightforward using the small claims proceedure. You can do it all online and, based on claim being less than £300 it only costs £30 fee to issue. This lot do seem to still be trading so maybe I will get some success.

    I think I am right in saying that you can return phones to companies like this within, is it 14 days, and cancel the contract...

    TS informed me I should issue them with a letter telling them they ought to comply with the TnC's and give the claim.

    I sent the later AGES ago via recorded delivery but Royal Mail are p*ssing about - so as far as I know t's STILL not been delivered!

    Can you believe it - I sent it on the 24th of July and it's the 6th of August and no confirmation....GRRR.

    Hi Yabbas - just to let you know, I did that, I sent a letter to PBD on 18 July and on 20 July I got an automatied email from their claim department saying they had received my claim (actually it was my second letter telling them to comply and pay up), the same kind of email as was sent when they got my actual claims..... and this was during the strike period so I would suggest there is something awry with the post and maybe you can follow up with the PO (just to make the whole experience even more pleasant for you :-(  )

    Good luck. Don't worry about the fact that the summons will be issued in the Northampton County Court. As an individual you are entitled to have the case heard in your local county court if the defendant is a company. This means that this lot will have to employ solicitors to argue their case down here in Eastbourne for a claim of £100 ish. We'll see.

    I'm thinking to do it as well, the small claim proc. i've checked the T&C and they say that they can amend the T&C any time.. very cleaver...ok but it didn't say that they shouldn't informe the customers..so i think that i've got the case, and of course any stupid he can understand that they've changed the T&C from 1 month to 21 days to make a fraud and make money..without give any notice to the customers!! they didn't even bother to reply my email..More legal actions that we can get more chances to take them down. They owe me £336, i don't mind to pay £100 for the claim. By the way for the site for the small claim proc. just copy it on google and you can get the address.

    Another thought.

    There has been some discussion in this forum relating to the fact that Moneysupermarket carries mobile affiliates advertising.

    OK. So lets use it to the consumers advantage. Give them a review using the customer review facility provided Moneysupermarket. Fair enough?

    I have taken Neillgb's advice and have given Cool New Mobile a bad review, I suggest (as you have suggested) that everyone really does do the same!!! I am still awaiting for Moneysupermarket to approve my review before it can be viewed. I wrote about Cool New Mobiles major disohnesty regarding their cashback schemes and their cashflow problems hence the reason for ripping of their coustomers.

    I've received a reply today from coolnewmobile, they said that ,

    As you signed the 21 day claim form, agreeing to get you claim to us within the 21 days, your claim will remain void as it was late.

    Ok then if they want war..war they will get!! I'll send a letter now to them that i'll do legal action against them, and after i'll file a small claim procedure, i really want to see how they can explain the change of the T&C without give notice...i've received a reply from t-mobile, that's the text,

    Thank you for your email stating that the company you purchased your phone from are not keeping to their cashback claims.

    I'm sorry to learn that you haven't been able to claim your cashback offer and I understand this must be frustrating for you. I agree if they're going to make any changes to their agreement, they should have kept you informed.

    Unfortunately, T-Mobile has no details of any cashback offers that are made by mail order company's. We're unable to regulate them because they're set up by the individual companies themselves.

    I know this has caused problems and I understand your disappointment. However I can assure you that these instances are few and far between.

    I also agree with you that it doesn't bring good publicity to T-Mobile and I'm grateful you've brought this to my attention. I'll ensure this is highlighted to the relevant department for you.

    So they agreed that there's a lack of honesty in the behavior of this bunch of gents...somebody here can explain how work the small claim procedure? if you lose what next? you have to pay fee ect.?

    Can you give us Maxine Wilson's contact details - my cashback claim from t-mobile has also been revoked.  Bombarding t-mobile with bad publicity is the next way forward it seems...

    I just post the email address with a space between becouse i'm not allowed to post a email address..?? Anyway i've already left a very bad feedback for coolnewmobile here on site, and i suggest that everyone does the same, maybe we lose the money, but we can help the people that are looking for a deal with the mobilephones co. when i did the contract, i was 3 nights surfing in internet to find a good company for the cashback scheme, and the feedbacks for them were good, but evidently they have changed in short time...was just a plan for them to make a lot of customers and after the 1st claim to scam them all!! It's needless to say that i'll not buy anymore a phone with casback..

    Yeah - I just did a review for Phone Box Direct and have submitted a claim now.....  What a crappy week this is turning out to be. :-(

    Thanks Neill, i've found it, it's very useful, but just in case that you lose? You have to pay fees or it just end up with your fee of £30-50? I've just read a posts related the cashback companies...my god!! there's a enormous amount of people that have been scammed by several companies..1 point is in common....they won't pay out at all!! they try everything to avoid to pay...it's really ridicolous that such a scams companies like that are allowed to rip off customers without any action from the relative associations that should help the consumers...
