    Hi - Yes, the court would make a order that payments were made direct to the claimant at a frequency and intervals, based on the affordability of the defendant. It could be a combination of part lump sum, followed with weekly / monthly payments or just the latter.

    hi thanks for reading my question so does that mean the claimant would receive a monthly/weekly payment rather than a lump sum.

    The court does not pay -- it would first make a damages award order of £XX XX's against the defendant in favour of the claimant.

    If the defendant was unable to pay this..... they should ask the court to make an affordable repayment order of £XX XX's monthly / weekly that was based on the defendant's financial ability, after income and expenditure balance sheets were presented to the court..

    hi can anybody help me with this question. if you have you pay compensation to somebody as the result of a car accident and your car insurance doesnot cover it does the court pay the award in full and then you pay the court in instalements if you cannot pay it in full
