    You are entitled to either a refund, replacement or repair under the sale of goods act 1979 (as amended) if the goods are not fit for their intended purpose or of the expected quality, they must be returned unused within a "reasonable period".

    This reasonable period can last up to Six years in the case of certain goods, therefore a pair of jeans such as in your case would be deemed to have been returned well within the reasonable timeframe allowed under the above act.

    Insist that you are rejecting the goods under the above act and persevere with your claim for a full refund, if they will not co-operate.... seek the involvement of your local trading standards dept.

    Incidentally; firms like Marks & Spencer and BHS amongst other leading chains, reject clothing that has stitching problems however minor ...and subsequently sell on the sub-standard products as, "unfit" to market traders as "seconds" after first removing any labels to indicate where the clothing originated from.

    Clothing Returns Policy - HELP!!

    On the 14th August I bought a pair of jeans from Diesel that cost £90. These were purchased to take on holiday on the 24th August so apart from trying them on in the shop I had'nt worn them until I arrived in the USA.

    When I did arrive I put on the new jeans and noticed that the stitching had come away at the seams (about an inch long) and as a precautionary measure I did not wear them again and decided to buy a new pair whilst in the USA.

    Upon my return I took the jeans back to the Diesel shop I had purchased them from and was told that the do not offer refunds where stitching is at fault (almost implying that I had done this), and they would repair this. As I had bought a new pair whilst in the USA I would have liked a full refund and was told that due to the purchase being over 14 days this could not be done (I did expalin I was in the USA at the time), also they did (finally) offer to exchange the jeans or offer gift vouchers for the sum. I have yet to decide the outcome and currently sitting with a needle and thread whilst logged into ebay to try and recoup my money.

    If possible could someone explain the legal aspects here and what grounds and ways I can do to get a full refund?
