    You do not need to pay stamp duty - as long as your wife-to-be agrees to transfer 50% of the asset for no money. Its only if you actually pay her cash that you will have to pay stamp duty.

    Have a chat with a conveyancing lawyer - should be able to help you over the phone in two minutes. Tell him you need a lawyer but need a quick piece of advice first.

    I'm not a legal expert but I'm fairly sure you can't be named on the mortgage without owning the house so your partner will have to sell to you or at least transfer half the house to you and then you could go for a koint applucation with you as the main applicant. Being married will make no difference to whether stamp duty will be payable.

    You would incur legals and valuation fees anyway if you remortgage (although you should be able to find a fees free deal) so the only extra is going to be the stamp duty.

    Hi Guys

    Heres the situation, my fiance has the house in her name - but now her credit rating is bad, and the mortgae is out of its 2 year fixed so a crazy rate at the moment.

    I pay the mortgage anyway but it is not in my name (in hers), we both want to get the mortgage in my name at a better rate fixed for 2 years, i am self employed but have very good credit and good income.

    The problem i see is that even though we just want to change the mortage over to me, in theory i have to buy the house from her but will incure stamp duty/legla expenses etc as property is over 250,000. which we do not want to do.

    We get married in November 2008, so would i then be able to be added to the existing mortgage then remortgage it in my name saving the hassle above???

    Any suggestions or similar experinces would be greatly appreciated!.
