    Cashback claim accepted - but not paid - Rainbow Mobile

    I foolishly agreed to a cashback deal from RAINBOW MOBILE last year. I followed the agreement exactly, and had my first 2 claims accepted. I received the payments late, but I was pleased to get them. My 3rd and final payment was also agreed to and I was told I would have it after 24 working days. This was in May! I have emailed about 5 times, each time receiving an excuse and being told it would be paid to me within 10 or 12 days. I have phoned the company and am told the same thing, and a manager is never there to speak to me. Can anyone suggest what I can do to take this further?

    Consider writing a letter to say what has been received and when, and what should have been received and when. Ask that the situation is rectified quickly. Send this recorded delivery. After a month write another letter saying that, as you had no reply (assumption), you will be taking action in the small claims court unless the payment is received by such-and-such-a-date. Then, at this date, print off the small claims form, complete it and send a copy to Rainbow. If you still don't have the payment soon after this stage you can proceed with the small claims procedure. This will cost £30 or so to process the claim but you can add this, and any other reasonable costs (like travel) to the amount you are claiming. More details are on

    Mobile Rainbow Cashback Problems

    Anybody thinking of giving up a valid claim from this company should think again!

    I took advice from people on a similar website as this and I now have had all my cashback paid and I have posted this to assist everybody else to getting their money from this unscrupulous company. Here's my story which I hope will help.

    I eventually had my first cashback paid some 2 months late after many emails and broken promises. However the second payment never arrived, even after many promises and deadlines were broken. Sounds similar! I sent my third cashback to them without the second having been paid. Then in early November I found this advice and I took it.

    I sent a letter via recorded delivery saying that they had commited a fundamental breach of the contract by not paying as agreed and therefore if both cashbacks were not paid by a certain date (a couple of weeks) I would sue. Don't worry if a cashback payment is not due yet. As they have breached the contract, claim the lot!

    No payment was forthcoming so I sued through www.moneyclaim.gov.uk. This looks a little daunting at first, but actually was very simple. I sued for breach of contract for non-payment of my second and third mobile phone cashback payments. Their Terms and Conditions state that payment will be made within 45 days of receipt of a valid claim. Explained what had been going on over the past few months and then stated that "Because of their breach of contract be sure to claim for the whole amount outstanding + court fees + expenses."

    They filed a defence but paid out the whole amount in early December, apart from the expenses which I am still fighting for.

    Have you tried this and has it worked. I have been promised my 3rd cashback installment on a number of occasions going back to September last year, although they have techincal difficulties, or are moving to new financial platform etc. Should I be going to claim on the small claims court?

    I would be interested to know how your story developed too. Have you been paid expences and court costs yet? I followed some earlier advice and ended up going to citizens advice. They were very helpful and contacted Mobile Rainbow for me with the evidence I provided them with. Low and behold, Mob R got back to them (unlike with me) but said that they were having financial difficulties and had a backlog of cashback claims which they hope to get paid out but required time. No date was given of course. I was told I had to either sit patient or go through the courts which could be costly and no guarantees were there that I would win. Should I sue? For anyone else ever considering a cashback deal - DONT and AVOID Mobile Rainbow like the plague!!

    I have just recieved a judgement in my favour against Mobile Rainbow (Msols) - they offered no defence against my claim for the first cashback (£i20 + £25 court costs) which I did online using MCOL. I have today been granted a warrant (£55 fee - added to the claim total) enabling Bailliffs to try and recover the money owed.

    The fact that Mobile Rainbow did not contest the claim makes me slightly concerned that I have wasted more time and money that is never going to be recoverable if they go into receivership/bust. My next line of redress will be against the network, in this case T-Mobile, as this is where the money is - some very interesting threads and guidance by a contributor called FUNFORUS elsewhere on this site.

    Stay tuned to this thread to find out the outcome of the Baillifs visit within the next week or so.

    Found out today that the Bailiffs have been unable to recover any money from Mobile Rainbow/Msols - the address in Watford consists of a telephone and not much else ( Bailiffs called it a virtual office ) so unless I re-issue the warrant for a different known address, costing another £20, they are not going to persue the debt.

    As I have no idea where these so-called business men run their empire from ( it is after all their registered head office) it looks like we will all have to concentrate on convincing the networks of their obligations.

    MY ADVICE IS TO DEFINATELY FORGET THE SMALL CLAIMS ROUTE - YOU WILL BE THROWING MONEY DOWN THE DRAIN, (I did it out of curiosity and have proved it is futile) - FOLLOWING THE ADVICE ELSEWHERE ON THIS AND OTHER THREADS IS THE ONLY WAY FORWARD.

    The conning bar stewards have made their money and run, lets make their masters pay.
