    I used to work in a phone shop ages ago and as much as I can remeber, if u take out a new contract, you have 14 days grace period in which you can cancel your mobile phone contract. This is your right by law. Obviously you would need to return the phone etc. in the 'original' condition. You will have to pay for the bill for your usage, if used and the network will send u a bill directly. I hope this helps.

    Good luck with your dealership, but please don't suggest that you should be contacted for the purpose of obtaining business through this forum, it contravenes the rules on touting for business.

    Why oh why do people use this company? This is not aimed at you specifically - it is just the musings of someone sick and tired of Craphone Whorehouse.

    Firstly, under the Sale of Goods Act, if an item is not "... fit for the purpose intended ..." then you are entitled to receive either a replacement or a refund regardless of any reseller's terms and conditions of sale. If you are buying a NEW item and it is patently NOT new, then this is "misrepresentation" which is effectively fraud.

    In your position, I would pack the handset back in the box, and return it to the branch demanding that you are given a NEW unit in accordance with their published advert. if they cannot furnish you with the contracted deal then it is the law that they must return your money and cancel any contract without further cost to you.

    I would NEVER use CPW for anything as they have become the most useless bunch of ... in the High Street. If you want a mobile 'phone deal ONLY with the networks - why deal with middle men? Please don't tell me that this was a cashback deal as this would be the icing on the steaming pile!

    Good old carphone warehouse. Bought two contracts from them five days ago, the 300 mins mix pack on 3. The girlfriends phone is fine, mine had a text message on it already and when I got it home it kept coming up 'please insert sim' every hour or so. I phoned carphone warehouse who agreed the phone was possibly a previous return, take it back. Took it back and got the same model, but again it kept coming up 'please insert sim'. So I decided to swap my sim with my girlfriends. Mine worked fine in her phone, hers had the same problem in my phone. So the phone is the problem. Went into the store to see the manager. Asked if I could change to a different handset as there was clearly a problem with the model (girlfriend has a different model). He said it is against policy to change for a different model, even though I had encountered problems with the same model twice in two days. OK I said, just give me another of the original model then. Then he says they don't have any in stock so I will have to wait two to three days. So I phoned customer services and spoke to them, they said that in this case I should be able to swap for a different model. I handed the phone to the manager and asked the CSA to repeat this.

    So the manager gets me out a Noki 6288 and starts processing the exchange. 'Don't I get a choice which model I get' I asked. No he replied, this is all you can get on that tariff. 'What about the sony ericsonn shown on the leaflet' I asked. Oh, this is all we have in stock he replied.

    At this point I just wanted a phone and to get away from this idiot after wasting an hour of my day. I looked at the box and noticed it was open and asked why this was. He said 'I just opened it now to make sure the phone was in there' I wasn't convinced and lo and behold when I got back to work and took it out of the box the battery was already in the phone and charged up.

    The phone does work so far (had it two days now) so I imagine that despite the bad customer service and being given two used phones I can't cancel my contract, (but I would like to). What are the chances of getting the phone changed for one that is actually new though, or are they entitled to give you phones that are not 'out of the box' new? And if I do get an exchange am I within my rights to ask for any model of phone that I want which was on that deal.

    Seems a strange way to treat somebody that has just bought two contracts off you, although perhaps they know it is so hard to get out of the contract at the end that customer service doesn't matter.
