i am new to this, but would like some advice if anyone could help.
my finace and i were involved in a car crash at the end of july...we were breaking for slowing traffic (1st car), the lady behind us broke too (2nd car)...the lady behind her did not break(3rd car), she smashed into the car behind us and went into a ditch, the lady in the car behind us then went into us... all 3 cars were a write off...(we were going about 10 mph when hit, lady behind us about 30mph- i dont know about the lady behind her but it was a 60mph road.) the police/firebridgade and ambulance service attended... when at the hospital the police came around and took statements off all parties involved... a while later the police came and found us again and said that they had interviewed the lady in the 3rd car under caution for driving without due care and attention...they said that she had admitted that it was her fault and that she had been looking in the back at her children when the crash happened... also the lady in the 2nd car at the scene of crash said she knew that the lady behind her had not been looking. she also said that she had plenty of time to stop her car...which my fiance has agreed to (he was driving)
the police then sent us out an accident report form, kind of like a witness statement thing... so we are waiting to see if the 3rd lady gets charged with driving without due care and attention.
i had a month off work due to this crash and my fiance and i have been and seen an independent doctor who has recommended that we have 6 sessions of physio. in the meantime direct line (our insurance company) have made my fiances insurance premiums go really high due to the fact they are saying that because the case is still open he has lost his ncb at the moment and when the case is closed he will get reimbursed... he is currently paying £100 pm whereas before the crash it was £60pm. which is quite a big difference per month!
so here we are over 2months down the line... and we recieved a letter from direct line saying that they are still chasing the third party for comments on liability and an accident report... direct line informed us that the insurance claim would be coming from the lady in the third car... what i don't understand is how can she be saying that it is not her fault?
she admitted to the police that it was her fault....the lady in the 2nd car witnessed her not looking at the road....
so what i am basically asking is how long is it before people have to accept liability? i just feel like this is just dragging on so so much, and quite frankly i would just like it over and done with. does anyone have any advice?
we have contacted solicitors by the way, as we have both had to make personal injury claims.. and we have alos had letters off them stating they are waiting on comments on liabilty.
