Thanks Huckster. I have just spoken to him and explained why we would not pay for the damage to his car and suggested he contact the club. I cannot understand it either, very surprised.

Re: Car accident attending public event - are we liable?

I sometimes wonder about some people. They park their car in car park without permission, damage it and then wander over to the organisers of a nearby car boot sale to blame them.

What planet is this person on ? If you are in contact with them again, tell him to contact the social club concerned, as it is them he needs to deal with. To make a claim against the social club, he would need to make a case that the social club owners were liable, in that their poor maintenance of the car park caused damage to his car.

Jon - There is no way whatsoever you could be held liable for this chap parking his car in a car park which has nothing to do with and is entirely unrelated to the event that you were holding, no matter what his intentions were. !

Even if he had used your designated car park..... he would then have been required to show or prove that the damage caused to his car was in someway due to the negligence of the organisers. (he's just a chancer)

He had no right to use the Social club car park without authority anyway unless he was a visiting patron of the social club itself.... not the car boot sale, otherwise he has parked without permission..... tell him to either go ahead with a futile lawsuit or better still save himself the hassle by claiming against his own insurance, if he has any.?

Car accident attending public event - are we liable?

Hi, this might seem an unusual one.

I volunteer for a charity and we held a car boot today on a field which we rent from a nearby social club. We have signs clearly indicating the entry to the field and on entering all drivers are met by our volunteers. All the booters and buyers park on the field and are shown where to go by the volunteers.

A man has approached us to say that he had damaged his car on the car park of the social club adjacent to the field, and as he was parking in order to attend our car boot we are liable.

I have explained that we do not use the social club car park - nor are we allowed to, but the man is threatening to take us to court unless we pay up.

Would we be liable for this? My first thoughts are that we would only have been liable if he had come on to the field and we had in some way influenced by negligence or otherwise him having an accident.

Any advice or reassurance would be greatly appreciated.

    Jon
