    UPDATE

    Upon threatening capital one with the closure of our acct they have eventually faxed the form,however we are no closer to resolving the dispute & we would strongly recomend AVOID CAPITAL ONE-they are not worth the aggro !!

    I cannot beleive you have let this problem go.................


    YOU MUST ENLIST A SOLICITOR IMMEDIATELY ( after presenting him with your full written unqueastionable evidence of the cheque being cashed by cap one)


    even if the cheque has been posted to a suspense account, legally cap one have received your funds and cannot hide behind that excuse.


    your damaged credit file is even more serious and this is something experian should be helping you with ( as required by their regulatory body )

    your solicitor can help here as well


    you MUST also involve the financial ombudsman who MUST based upon your FACTS rule in YOUR FAVOUR...........this ruling will be BINDING upon cap one and if they do not comply then they will be fined etc etc.


    do not give this one up !!!!!!

    Don't have anything to do with them. I am still in dispute with them after four years and am considering taking them to the County Court.

    In February 2001 I decided to pay of the balance on my card (only £250) and have nothing more to do with them. My bank have provided evidence that Capital One presented my cheque for payment and have received the funds however Capial One still refuse to acknowledge this and show a default on my credit file which they are refusing to remove.

    cap one are arrogant and slow at anything to do with customer service

    I had a letter they produce don 2/10/06 which took over 10 days to physically reach me ,despite being sent 1st class.............they just pass the buck to royal mail business post service......................"out of our hands"...................


    what utter rubbish...................other companies I deal with can respond efficiently within 4 working days...................cap one's guideline is "10 days"


    yet, they DEMAND the customer send spayment "on time"


    yet, when I ask them "can I use your excuse for postal delay in my payment to you" they say................of course not !!!!!!!

    Capital One

    Warning-be careful of Capital One!!

    My wife & I have a joint capital one account & today have tried to dispute an un authorised debit on the account.ok say capital one we'll send you a form in 5-7 days but in the man time as the unauthorised debit has taken you over your limit PAY UP !
    When asked to fax or e-mail the form capital one say it's against policy !
    So we either wait for the form or tell them to keep their form & close the account-no prizes for gussing what we've decided to d !!
