    Cancelling Contract..

    Im trying to cancel my Contract as it is not due to be upgraded to April. Even though April does not seem that long away. I want to start a new contract. I have got a samsung toco but its broken because the touch has stopped working. It is still under warrenty but Orange won't do anything about it so im stuck with a old phone and still paying for one thats broken.

    Is there anyway i can transfer my contract onto a new contract or cancel it without any charges. I also did not receive the text to say there call minutes were going up to 14 per minute. I went over my phone bill last month and ended up paying double my contract. Because they didnt tell me the minutes had gone up is that a breach of contract?

    It depends on the contract wording. My feeling is that, if the phone is part of the deal and if it is still under warantee, you should be able to, for example, ask that it is repaired or replaced within the next six weeks or you will consider them in breach of contract (you do have to give them a reasonable chance to put things right). If you do go down this route, you should be ready for a few nasty letters when you stop paying the bills but, as long as you document your case properly, you would be in a strong position should things get as far as court. The first steps though are to write (keeping copies and posting receipts), explaining the problems and asking that they are put right within a reasonable time.
