I've had my Nokia N97 for about a month and it has already been replaced because of problems (phone keeps freezing so have to keep switching it off or taking the battery out) and the replacement has the same problem. Vodafone will send me another new replacement but after 28days of receiving the first phone they will only make repairs. I have already protested this is unfair but they tell me is 'their policy'. Is it possible to cancel the contract?

Your contract with vodafone is for the mobile phone service, not for the phone itself. Having said that, they should repair the phone for you, and if they can't repair, they will replace it, as per the manufacturer's warranty.
