    What have you got to lose?

    All the costs of the case, plus whatever damages the judge awards..

    If a judge decides you've pursued a matter unreasonably you can be liable for all the costs. Legal cover will only cover you if it's reasonably likely that you'll win. So if legal cover think you haven't got a case, then you'll have to pay all your costs, and risk having to pay the other sides costs as well.

    You will find that with the legal cover, it is up to DL whether they take action.

    Instead you should raise a complaint with the DL claims manager to look at the witness statements and consider rejecting liability to the 3rd party pedestrian.. If the won't ask them to explaint why.

    captain-random:i had an accident involving a pedestrian and have recieved a letter saying that there are going to pay out. I have legal cover with direct line so can i object and make them take it to court?

    The answer is no and why would you want it to go to court.

    Are you blaming the pedestrian for the accident and if so do you have witness statements or CCTV.
